01/22/2004 02:59 AMI personally believe that meetings that go on for hours without a
single break should be banned. There's no time to do your email
(which normally takes an hour or two), nor there's any chance to
just... relax. So people drudge along, trying to keep together
whatever strings of consciousness they still have after a few hours,
and nobody really remembers afterwards what was decided, because
everyone was forced to do multiple things at the same time. The world
does not stop for the meetings, as much as we would like it to.
On a completely different note... I wrote a short
thing about the art of letting go, after many long discussions
with friends, who have opened my eyes to see whole new worlds. In a
few weeks I'll consider it completely crap, and use printouts for
target practice, but for the moment it says - in an awkward, clunky
sort of way - some things that I have learned. Hope you like it.

the 6th Circuit Court of Appeals. Sampling, we're told, is piracy. But
be certain to see the 19 footnotes in this relatively brief opinion,
or the 28 separate quotes the opinion includes from other peoples
work. I assume the court got a license for those.
Now that's not quite fair. The court's decision turns upon its
"literal" reading of the sound recording statute. The sound recording
statute has no de minimus exceptions, the court held. So while you are
free to copy three notes from a musical composition, you can't copy
the same three notes from a recording. So copying (so long as de
minimus) is fine; cut & paste is not. It is a "bright-line" rule the
Court has crafted: Ask permission first. (And don't worry, they might
have added.
It's
simple.)
So once again: life in the analog world is freer than life in the
digital world. You can do it, just don't use technology to do it --
unless, of course, your lawyer has spoken to their lawyer.

You can always quote a few lines without asking permission, but that's

repetition. Quote the whole speech to make a more substantial point,
and you face thousand-dollar license fee claims from the estate. Quote

Pepper, Chief of Policy Development at the FCC and my former boss and
mentor, is leaving the Commission. (He just told me the internal
email went around announcing his farewell party, so that makes it
official!)
Pepper is irreplaceable. He's the institutional memory of the FCC
on pretty much every important policy issue. And he has been at the
center of tech policy strategy at the FCC since before the commercial
Internet emerged. I don't have time right now for a fuller
appreciation, but it's a great loss for the FCC.

seemed like an odd strategy. Perhaps I don't understand the porn
market very well, but are people really
that hard up for porn
that they want to be able to view it on a tiny screen on the go?
Either way, it looks like a roadblock may now be in the way. With the
fear that (gasp! oh no!) kids might actually view porn on a mobile
phone (as if they can't already access it on the internet), mobile
phone operators in the UK are quickly trying to block out the porn
(which, for some reason, they think is actually possible). Vodafone's
latest strategy is to block all porn

nless you somehow prove yourself to be an adult by giving them a
credit card (which I'm sure plenty of kids have access to) or
showing up in person at a store. I'm sure that will be a
popular option: "Hi, I'm here to get porn on my phone!" Looks like
some of that expected (if questionable) mobile porn revenue may have
just gone out the window.
