131 words from On Bullshit violates
copyright? Bullshit! -- UPDATED
03/17/2005 03:56 AM
Cory Doctorow: A reader writes, "Much-blogged 'On Bullshit' essayist Harry Frankfurt, of Princeton's philosophy department, has asked me to pull a 131-word excerpt from his essay from my blog, saying that it'll hurt his profits. Has the guy--an academic, no less--never used quotation in his work? Never heard of fair use?"

Here's 131 words from On Bullshit for your perusal. In my view, the claim that this is either a "clear infringement" of copyright or will displace sales of the book is so unlikely as to constitute bullshit.

One of the most salient features of our culture is that there is so much bullshit. Everyone knows this. Each of us contributes his share. But we tend to take the situation for granted. Most people are rather confident of their ability to recognize bullshit and to avoid being taken in by it. So the phenomenon has not aroused much deliberate concern, or attracted much sustained inquiry. In consequence, we have no clear understanding of what bullshit is, why there is so much of it, or what functions it serves. And we lack a conscientiously developed appreciation of what it means to us. In other words, we have no theory. I propose to begin the development of a theoretical understanding of bullshit, mainly by providing some tentative and exploratory philosophical analysis.

Update: Paul sez, "It seems Harry Frankfurt isn't a copyright monster, but just a bit confused. He emailed me the following. If you wouldn't mind doing an update..."

Dear Mr. Schmelzer,

I've looked at your site, and I have no objection to the excerpt from my essay that is presented there. I apologize for any suggestion that you might have done something improper. Indeed, I am grateful to you for the honor that your attention to my work does me.

Harry Frankfurt

Canadian Copyright Board allows

Canadian Copyright Board allows
downloads, copyright levies
12/14/2003 12:27 PM

The Copyright Board of Canada issued a ruling on " private copying ", largely via peer-to-peer computing, with several components. First, downloading is acceptable, but uploading is not (presumably to target hyperpirates). Second, new mechanisms for levies were described, freezing current ones, allowing new charges.

the Copyright Board said uploading or distributing copyrighted works online appeared to be prohibited under current Canadian law. However, the country's copyright law does allow making a copy for personal use and does not address the source of that copy or whether the original has to be an authorized or noninfringing version, the board said.

UK to Get Top 20 Ringtones Chart 06/01/2004 01:53 PM

kpmg_logo.jpg imageUK accountancy firm KPMG is starting a 'Top 20' chart to keep track of Britain's most popular mobile phone ring tones. By aggregating data from the mobile companies themselves, KPMG hopes to become the official reference for the burgeoning ringtone market. It seems it's needed, too. Right now Ringtones.co.uk reports 'I Don't Want You Back' by US singer Eamon (who?) is number one, yet Nokia puts Britney Spears' (who?) single 'Everytime' on top.

Radio One download chart

Radio One download chart 09/01/2004 07:30 PM
The BBC's Radio One, a popular youth orientated radio station in the UK, has launched the first download chart. Similar to the world famous top40, broadcasted weekly on a Sunday, the download chart will feature the top 40 downloaded songs, each Wednesday at 6PM, on the Scott Mills show.

Lostprophets band member, Mike, told the BBC that "I like to search the internet for new bands and stuff, so I'll look on a lot of music websites and download some mp3s." The BBC and the UK Charts company compile the data from legal download sites (e.g. Napster & iTunes, MSN Music). The first #1 in the chart was 'Flying Without Wings' by Westlife. The chart featured a variety of artists, some of which might not enjoy the same status in the non-download singles chart.

Asides from being a nice addition from the BBC, it marks an important point for the online music market; starting with Napster, it has taken 6 years for it to gain official recognition, status, perhaps respect, that it deserved from the start. Watch its future unfold.

To develop an understanding of copyright law and how it applies to you, you need to develop a thorough understanding of what you are allowed to do under copyright, and, what you are not allowed to do. One way for you to get there is to critically analyze a number of copyright scenarios and discuss them from multiple perspectives. That's your task in this exercise. If you're short on time, patience, or want to try a different way, you may want to review the presentation and then take the online quiz. iTunes UK Gets iMix Write-Indie Campaign 06/29/2004 12:16 PM

UK iTunes Music Store users have hijacked (sortof) the iMix service to lambast Apple for its lack of indie labels on its newly launched European version of the service -- a lack perhaps more noticable in the UK, as many notable and popular artists release albums on smaller, independent labels. Fans can make iMixes and anonymously upload them to the Music Store with their own titles, some of which include "ITUNES NEEDS INDIES," "Where is the Radiohead 5-inch," "Release the Indies!," and "Bigger, Gayer, Camper."

That last one may have its own agenda, come to think on it.
