China has revoked Pfizer's patent over Viagra, a move that Lawmeme argues is a precursor to widespread dismissal of pharmaceutical patents.

In what appears to be the first pharmaceutical patent revocation, China has revoked the patent. Not long after the patent was granted, pharmaceutical producers (12 in this account) requested re-examination. It isn't quite clear yet exactly what happened at that re-examination. Some claim the patent failed the detailed description required by Article 26 of China's patent code. Others claim it failed the novelty requirement. Pfizer claims its patent still stands pending appeal. The Viagra patent was already poorly enforced, and now the prognosis looks even more bleak for Pfizer.

A federal court today tossed out a law that banned the sale of bootleg recordings of concerts, noting that the law had a variety of problems that did not fit with copyright law. First, since copyright law only deals with protecting works for a "limited time" (Eldred/Lessig notwithstanding), and the ban on selling bootlegs had no time limit, the judge found the law went against the spirit of copyright law. Much more importantly, however, the judge claimed that copyright only applies to "fixed" works such as books or released music. A bootleg, by its definition, then is not a fixed work and thus not covered by copyright law. As you might imagine, the recording industry is freaking out about this decision, and there will almost definitely be some kind of appeal. If not, expect the entertainment industry's friends in Congress to close these loopholes as quickly as possible. Of course, a more enlightened recording industry might realize that encouraging the practice of bootlegging helps increase interest in the band both for sales of recorded albums as well as the ongoing purchase of concert tickets -- but that's a much more complicated concept than "we must control absolutely everything."

Remember back in June when Barbara Streisand filed a lawsuit against Ken Adelman for photographing her home as part of his effort to photograph the entire west coast of the US for environmental purposes? Despite the fact that it was one of many thousands of photos, shows very little detail and was taken from public airspace, Streisand claimed it violated her privacy. Well, now a judge has looked at the suit, scoffed, and tossed it out, saying that the lawsuit actually infringed on Adelman's right to free speech. Once again, this is an example of trying to hide something online - and in the process drawing a lot more attention to it. If Streisand hadn't spoken up, very few people would even know the photo existed. Now, millions do - and it's all completely legal.

Details are sketchy on this one, but it sounds like a federal judge has dismissed a lawsuit filed by AOL against some spammers because the judge claims not to have jurisdiction over the spammers. The spammers are in Florida, but AOL (and the court) are in Virginia. Once again, the question of jurisdiction online becomes important. Should the spammers be liable in Virginia because their emails hit AOL's machines (based in Virginia) or should it be filed in a Florida court?
