more from representing SCO in its $3B lawsuit alleging IBM stole trade
secrets over Linux software-- even if SCO's case is unsuccessful.
Documents SCO recently filed with the Securities and Exchange
Commission say the Lindon, Utah, software firm "is in the process of
finalizing" a deal with its counsel. Under the agreement, SCO would
pay the lawyers 20% of the proceeds of "a sale of SCO during the
pendancy of litigation." SCO is suing International Business Machines
Corp.
In 4 p.m. trading on the Nasdaq SmallCap Market Wednesday, SCO was at
$17.87, giving the company a market capitalization of $247 million. If
SCO sells at that price, the Boies firm would be entitled to $49.4
million -- and probably more with the premium that usually comes in a
takeover.

The Media Access Project's Harold Feld attended yesterday's Grokster
hearing and has blogged his impressions of the proceedings:
Don Virelli led off for the recording industry. He began with the
assertion that Grokster's P2P software has no legitimate uses. The
justices reacted skeptically. "Didn't the court below find lots of
legitimate uses, such as distribution of public domain works or
distribution of works authorized by the rights holders, even if the
vast majority of traffic was arguably infringing?" Virelli stuck to
his guns, thus falling prey to the trap that has undermined industry
so many times in this fight: they over sell.
Scalia then started in on innovation: "But what about inventors? How
will they know what people will use this for? Do they get a free ride
for a few years to see if the predominant use is infringing or
non-infringing?" Again, Virelli went too far. "In reality, these
people don't get sued just for inventing stuff" he claimed, while the
entire bar section rolled its eyes. Again, the Justices weren't
buying. "Inventors need certainty they won't be sued or they won't
invent," said Breyer.

04/09/2004 04:11 PMThe Tyco CEO and CFO are in the news right now after a mistrial (st
ory). Allegedly they looted $600 million from the
company. This sounds bad but if you look at this profile of
Tyco, the $600 mil is less than the most recent quarter's income of
$720 million and only about 1% of the company's market value of $58
billion. Let's compare that to some other looters in the
news:
- Richard Grasso took $200 million or so that he took from the New
York Stock Exchange, a non-profit org. Grasso's haul is roughly
comparable to ten years of profits for the NYSE. Grasso got his
looting approved by his friends on the Board and therefore won't face
criminal prosecution though the NY State attorney general is trying to
force him to repay some of his booty.
- Jack Welch, in his autobiography, talks about having transferred
30 percent of General Electric from the investors into the hands of
"employees" (the lions share to himself and a few other top guys
presumably).
- William T. Esrey and Ronald LeMay looted $311 million in one year
alone from Sprint, about half of the company's profits in a good
year. They were not prosecuted for their looting but the IRS
became upset with their scheme to avoid paying any taxes on this
income.
From the very fact of their prosecution we can infer that the Tyco
guys did not dot their i's and cross their t's as effectively as the
average corporate looter but is there any evidence that their looting
was above average?

Dapreview got their hands on the BenQ JoyBee 720 at this
year's CeBIT, and they appear to be full of almost nothing but
complaints. Though the unit brings back a flash media expansion slot,
they say the size of the unit itself and retroness of its internal
menus strike a fatal blow. I guess you can't really tell from the
picture, but the unit does appear to be pretty enormous.
