A fascinating post over at Lawmeme discusses a case where someone's lawyers were accused of hacking into The Internet Archive in order to access certain archived web page that could be incriminating. The company in question, perhaps realizing the problems with those web pages, had asked Archive.org not to archive their sites. Somehow, however, they claim the law firm of the other party "hacked" into archive.org to access the data anyway. It's not at all clear how someone could hack into archive.org to access the material, but as James Grimmelmann notes, this seems like a legal issue worth watching. It didn't become a major issue in this particular case, but it certainly is likely to come up again in the future.

Their goal in digitizing these texts and putting them online is to provide easy access to a rich and fascinating core collection of archival texts. By providing near-unrestricted access to these texts, they hope to encourage widespread use of texts in new contexts by people who might not have used them before. Currently included: 1) Canadian Libraries, 2) Million Book Project, 3) Children's Library, 4) Project Gutenberg, 5) Arpanet, 6) Dance Manuals, 7) Internet Bookmobile, and 8) Open Source Books. This will be added to Academic Resources 2005 Internet MiniGuide.

Brewster Kahle's Internet Archive project is really a great thing, but should there be only one such archive? It looks like they may be getting some competition in the form of the digital junkyard being built at the University of Waterloo. They claim it's the "world's largest" archive of digital content - but I wonder if they're really larger than the Internet Archive which is quite large and growing every day by leaps and bounds. It's going to contain all sorts of odd content, though, including "everything from movie outtakes to the sound bites left on the editing floor during the shooting of a music video." They say they plan to make it available to anyone who wants access, but don't say how they plan to do so. Right now, however, it's not easy to find at all, and after a quick search, I've given up until someone with more time/knowledge of this project points it out.

Search giant Google has launched yet another initiative, a project to digitize old books in collaboration with a group of leading libraries ( Harvard University , the New York Public Library , Oxford University , Stanford University , and the University of Michigan ).

The intent of this collaboration appears to be :

to expand the Web beyond its current valuable, if eclectic, body of material and create a digital card catalog and searchable library for the world's books, scholarly papers and special collections.
Copyrighted materials will be available only in small selections.

Also in development, but unrelated to the Google effort, the Internet Achive has launched the Million Book Project , which will digitize that many books from libraries around the world. The Archive is also beginning an open access archive . Following its open-access tradition, the Archive has arranged with libraries to make entire books accessible to the world.

Linspire's lawyers (formerly Lindows) apparently need work after their losing battle with Microsoft. Now they're testing Apple's resolve by announcing LPhoto and LSongs . Two applications that bear more than a little resemblence to iPhoto and iTunes. Apple may be smaller than Microsoft, but it doesn't take too much research to find that they take their intellectual property very seriously. Unlike their last battle with Microsoft, I have a feeling they'll get to keep the names, but the apps will no doubt look vastly different by the time they are released.

531 more music file sharers sued: Settlements in these cases are averaging $3,000 each. If the music industry is trying to intimidate people, it's working. I don't have Kazaa on my home machine anymore, and these news reports are a big reason why.
