rally in Central Park (United for Peace and Justice v. Bloomberg,
111893/04), and here is what NY Supreme Court1 Justice Silbermann
said: [...] the evidence established that the department's
determination was based on entirely content-neutral factors, to wit:
that the Great Lawn2 was not an appropriate venue for a demonstration

Eldred v. Ashcroft today. The case challenges retroactive copyright
extension. Links to online coverage (note that regular members of the

Commentators agree that the economic (extending copyright another time
helps only a small elite) argument was much better received than the
First Amendment argument (retroactive extension harms speech as once
free works can no longer be distributed). That might mean that the
justices will acknowledge that Congress has erred, but will not rule
in Eldred's favor for lack of a constitutional argument that convinces
them. The court's ruling is expected in a few months, transcripts
should be available in 2-6 weeks. We'll keep you posted. (Note to

In honor of the 150th anniversary for Thoreau's Walden, Creative
Commons co-founder Eric Eldred decided to share and print free public
domain copies of Walden (here's the Word doc
version at Eldred's own site) at Walden Pond,
but was asked to leave.
The Boston Globe published an article about this yesterday, complete
with a great photo of Eric sporting a Creative Commons
t-shirt.

I've been having ever so much fun with my well-travelled iBook and
Apple Repair. At OSCON last week a few people pulled be aside
(separately) and told me I should've said something--it would've been
taken care of. Which, had I know it was going to be six weeks, I
would've. Well... it's happening again. This time the case screws are
carrying a charge when the thing's plugged in, which means I've got
something shorting across the case ground. I assume someone tightened
some screws down too tightly or crimped...

04/14/2005 06:23 PMAfter quite a long battle, the courts finally decided that ISPs
didn't
have to just hand over subscriber info whenever the RIAA came
calling. The RIAA needed to first file a lawsuit and a subpoena --
going through the official legal process to get someone's info.
However, what happens when an ISP
does just hand over a name?
That question is now being raised, as a
woman has sued Comcast for disclosing her private
information to the recording industry, claiming they violated her
privacy. No lawsuit was filed by the RIAA. Comcast just gave her
info over to them -- and the RIAA then passed it on to some sort of
collections agency. What's strange here is that, while Verizon was
clearly willing to fight to protect the privacy of its subscribers, it
appears Comcast had no problem rolling right over when the RIAA came
calling.

America's largest cable provider is being sued by a woman who claims
the company voluntarily forked over her personal account data to the
RIAA.
In a lawsuit filed in King County, Wash., Dawnell Leadbetter said that
she was contacted by a debt collection agency in January and told to
pay a $4,500 for downloading copyright-protected music or face a
lawsuit for hundreds of thousands of dollars. Leadbetter, a mother of
two teenage children, was a customer of Comcast's high-speed Internet
access service.
The company, Settlement Support Center, based in Washington state, was
using information that the Recording Industry of Association of
America had obtained in a Philadelphia lawsuit over the illegal
sharing of digital music files, said Lory Lybeck, the lawyer
representing Leadbetter.

But no court authorized Comcast to release names and addresses of its
customers, or notified his client that her information had been given
to an outside party, Lybeck said. "Comcast should respect the rights
of privacy who pay them monthly bills," Lybeck said.

Supreme
Court fame) recently went to Walden Pond to hand out free copies
of David Thoreau's "Walden," which is very much in the public domain
these days. He was
quickly told to stop because he did not have a permit
to hand out free books. The park supervisor claims they told him to
leave because handing out free books might interfere with the business
prospects of the "Shop at Walden Pond" which sells copies of the book.
The executive director of the Thoreau Society, which runs the shop,
didn't seem to mind, and the whole thing is somewhat farcical given
the nature of "Walden" anyway.

Don asks what's the big deal.
His point of view is interesting.
It's very true that Google has failed to keep up with the
"search engine optimization" tricks that cause links to porn sites to
show up on our Referers pages and blog post comments. As we've said
here several times, and thought many more, Google is the place where
this practice should be stopped. It's because of Google that our sites
are littered with links to these offensive sites that have nothing
to do with ours. If they're smart enough to come up with tricks
like Google News and Local Google, why can't their search engine
recognize comment and referer spam and not use it in determining page
rank? Of course they can. Why don't they? I'd love to hear an
explanation. Better yet, I'd love to see them fix it. It's a bug in
Google's software.
Maybe secretly Google really doesn't like blogs. Maybe it's not
so secret. They still haven't deigned to support the standard format
for syndication, as every other tech company and major publisher has.
Why Google has a stake in breaking the standard is another puzzle. How
does this relate to Don't Be Evil. We've asked this question a few
times, only to be met with the usual Google stone wall.
This is not a public company but they have public stock now.
And while they think they're real special, like Don Park, I'm not so
sure they are. I made $800 on my Google stock yesterday, that paid for
my hotel and gas and then some. But I'm paying for their deafness in
other, imho more important ways. This is a company that desperately
needs competition, and I hope they rise to it, instead of folding, as
the previous Silicon Valley wunderkind (with the same backers) did.

The Open Park Project is a non-profit working to establish free public
WiFi connectivity on the National mall in Washington, DC. I'm one
of the co-founders, along with Washington telecom lawyer Greg Staple
and two others. On Wednesday, Open Park launched its
Website and its first location, on
Capitol Hill.
Hard to believe, but this is the first public outdoor WiFi hotspot in
Washington, DC. The area around Supreme Court, the Capitol
Visitor Center, and the Library of Congress is now "lit." Next
stop: a wireless mesh from the Capitol to the Lincoln Memorial.
Not just for free connectivity, but ultimately serving as a testbed
for
new wireless technologies and applications. We've received a
generous hardware donation from Tropos Networks and plan to announce
support from other companies and foundations soon.
I'm excited about this project both for the important symbolism and
for
the real practical benefits of a WiFi zone in the heart of the
Nation's
Capitol.
