It's no secret that pornographic pictures from one porn site quickly get copied to plenty of other porn sites. It seems that one porn site is taking an interesting strategy in trying to deal with this issue. Instead of going after those who copied the pictures, they've decided to sue the credit card companies that process payments for the sites that have copied their photos. The official reasoning is that they're suing the credit card companies for copyright infringement because the credit card companies are profiting off of the transactions on these other sites. That these credit card companies haven't actually infringed on any copyrights doesn't seem to enter the picture. This is, of course, the typical response to the "who do you sue?" question. The answer is always "the company with the most money" - even if that company hasn't actually done anything wrong.

Royalties of more than $573 million were distributed to our songwriters, composers and music publishers, an increase of $40 million or 7.5% from the previous year, and the most ever paid by an American PRO." Another interesting tidbit: "During the period 1995-2004, BMI had an average annual revenue growth rate of 9%..." If I read this right, BMI has been reporting solid growth over the last nine years, which makes me question the industry's claims about P2P. Either P2P ate into their growth (not mentioned), they found a way to cope with it (plausible), or it may actually help music sales. Whatever. Reminds me a bit of a spec I did for a life-insurance company's radio ad: Money , Money, Money (mp3 file)."

Suing the Saudis The Port Authority of New York and New Jersey has decided to join a $7 billion lawsuit that was filed last week by bond brokerage firm Cantor Fitzgerald, which lost 658 of its employees--two thirds of the firm--in the 9/11 attack on the World Trade Center, which was three years ago today. It looks like they may be gearing up to use RICO: "[The lawsuit said] Saudi Arabia engaged in a pattern of racketeering as it participated directly or indirectly in al Qaida's work through its "alter-ego" charities and relief organisations, which it funded and controlled." Al Qaida is named as a co-defendant, and four Saudis are mentioned by name: the interior minister, the defense minister, the governor of Riyadh, and the British ambassador, all members of the Saudi royal family.

A year ago, a group of spammers anonymously teamed up with a lawyer to sue a bunch of anti-spam groups. After those anti-spam groups fought back, the spammers eventually dropped their case. However, now we've got a similar situation. Scott Richter, the well known spammer behind OptInRealBig, is now suing IronPort, the folks who bought SpamCop last year. He's asking for $1 million in damages, saying that SpamCop has damaged his reputation. Has he given any thought to the idea that sending spam may have damaged his reputation? Among the many charges filed against SpamCop, Richter included Negligent Interference with Prospective Economic Advantage, Unfair Competition and Interference with Contractual Relationship.

It seems that Google's trademark lawyers are busy these days. Last year, they were sued by the creators of some children's toys/books called the Googles and that was quickly followed up by a dispute with the guy who ran a shopp ing search engine at Froogles.com, which Google obviously felt competed with their own Froogle.com. The big problem, though, was that Froogles had been around longer than Froogle (whoops!) leading to an arbitration panel letting the guy keep his domain. Google tried to defend their position by noting that Froogles was confusingly similar to Google (not Froogle). This way, they could make the claim that Google had been around longer than Froogles. However, what the arbitration panel doesn't give, perhaps the courts will. An unofficial Google blog is noting that Google has reopened the case -- probably after the guy refused to settle and was holding out for a bigger offer. Once again, though, Google is focusing on the earlier claim that Froogles infringes on Google -- and they go so far as to state that any use of "OOGLE" in relation to search may be considered infringement -- which might be a pretty credible claim. It seems unlikely a company would use "oogle" without there being some confusion with Google.

A consumer-rights group is bringing suit against US mobile carriers for locking their handsets:
In the lawsuit, the foundation said that because the companies all use the same wireless network standard, called GSM, customers should be able to use the same phone across those carriers' networks just by changing out an easily-replaced unit called a "SIM card" inside the phone.
The carriers may claim that locked handset let them offer cheaper service -- because they keep you from using your subsidized handset with another carrier, but I don't buy it. I got a free T-Mobile handset by promising on pain of an enormous cancellation fee to stick with them for a year. In the meantime, why shouldn't I be able to rent a SIM when I go to Toronto and put it in my phone? In the ongoing ridiculousness concerning the spammer who sued SpamCop, a judge has denied Scott Richter's request for an injunction against SpamCop, noting that by simply forwarding on email messages as a complaint, SpamCop is protected via the CDA, which says that service providers aren't responsible for the content sent through their services (the same reason that AOL shouldn't be sued when someone uses their service to do something illegal -- oh, whoops< /a>). However, the judge also went further pointing out that even if they weren't covered by the CDA, she saw no reason to grant the injunction. She said Richter and OptInRealBig failed to prove its case that SpamCop was in any way libeling them, since SpamCop never states that their reports are definitely spam. Also, there was no evidence that the company acted with "malice" against OptIn. The judge also denied Richter's request for emails from SpamCop claiming that giving Richter those addresses would be the equivalent of: "one who either intentionally or unintentionally sends pornography to minors, who then asks for a list of those minors so he will not continue to commit the crime."

Cory Doctorow: Yesterday the music industry announced lawsuits against users of a P2P file-sharing service that's optimized to run on Internet2 links, which are high-speed Internet links that mostly run between universities.

Ed Felten has a brilliant analysis of the strategy in suing Internet2 users: by painting it as a "specialized" network with centralized control, the recording industry can position new rules for Internet2 that will cope with the "new" problem of infringement on I2 links.

Of course, the music doesn't have a new problem on Internet2 -- MP3 copying doesn't need 400 megabit per second links to be effective. The problem of Internet2 P2P is identical to the problem of Internet P2P. But now the music industry can rattle its sabers and threaten the existence of systems optimized to move large files over high-speed links.

Given all of this, my guess is that the RIAA is pushing the Internet2 angle mostly for policial and public relations reasons. By painting Internet2 as a separate network, the RIAA can imply that the transfer of infringing files over Internet2 is a new kind of problem requiring new regulation. And by painting Internet2 as a centrally-managed entity, the RIAA can imply that it is more regulable than the rest of the Internet.
