It's unfortunate that companies still feel the need to equate patents to "innovation" when the opposite is often true. These days, unfortunately, many companies feel the need to get patents simply as a defensive measure. Whether for defense or offense, it appears that Bill Gates believes Microsoft needs more patents. The company is ramping up their efforts to file for more patents and plan to extort license them to other businesses. So far, they're off to a good start. Some recently noted Microsoft patents include savin g the name of a game you're playing, showing that someone is "typing a message" in IM software, threa d based email, writing an application in HTML, groupin g programs together in the taskbar, pronoun s used in programming and the concept of giving "kudos" points for style and flair. Well, kudos to Microsoft then, on the style and flair with which they've been granted so many questionable patents.

A patent for which Microsoft applied on March 6, 1997, has been granted: "Discoverability and navigation of hyperlinks via tabs." In other words, when a computer user uses the Tab key to move the focus from one hyperlink to another on a webpage opened in a browser, the use of that function is now owned by Microsoft. The Tab patent, number 6,785,865, was granted on August 31st, just one among multiple patents granted to the software giant on that day. Another interesting grant is number 6,784,354, with an application date of March 13, 2003: "Generating a music snippet." Yes, you read that right. Now dividing a music stream into portions is Microsoft's domain.

Gary Potter writes "Seems that a federal court in California granted a Microsoft motion to invalidate two patents for an ergonomic keyboard. Microsoft argued their claims pre-dated those of TypeRight Keyboard Corp. Then, in a twist of events, the US Court of Appeals for the Federal Circuit in Washington DC said there was "genuine issue" with the credibility of a Microsoft witness. Bottom line, the invalidity judgment was improperly granted. Next step, trial and lots of billable hours by lawyers." The article is pretty sketchy on details, but it certainly appears to imply that someone fudged the prior art proof.

In what's most likely to be the result of a screwup at the patent office, it appears that Microsoft has patented Apple. Well, not exactly. A new patent has been issued on a new type of apple, and for some unexplained reason, the patent has been assigned to Microsoft. The patent makes no mention of Microsoft, and the most likely explanation is that someone filled in the assignee field incorrectly. However, it makes for an amusing headline, sure to get plenty of attention.

In response to my post about a Microsoft presentation at Emerging Tech, Bob "Professor" Morris points us to a Microsoft page that explains something important about its XML schema for Word, Excel, etc.: Microsoft may have patents and/or patent applications that are necessary for you to license in order to make, sell, or distribute software programs that read or write files that comply with the Microsoft specifications for the Office Schemas. So, Microsoft's patents prevent me from writing a program that reads a Word XML file? Wow, that's harsh. And besides, isn't "schema" already a plural?...
