maintaining NetWare as a third party (i.e., "outsourced" support) then
a program Novell has just instituted in the U.K. might be of interest.
Of course, it's of great interest to those in the U.K. but it's also
of interest to the rest of you either because Novell may already (or
soon will) have something similar, or because you could use it as
ammunition to encourage an equivalent program in your country.

01/26/2004 03:02 PMI just bought some really cheap software: it's $199 retail, and I
got it through an Amazon reseller for $17.90 plus tax.
The seller had a great feedback rating. I was still a little wary,
so I emailed him before buying and asked what the catch was. No
catch, he assured me, it just didn't come with a box. For that kind
of savings, I figured I had nothing to lose, so I bought it.
Now I wonder: what is my responsbility in this transaction? How
much due diligence do I have to do to make sure that this software
isn't pirated? The seller tells me:
There is no catch. You will receive brand New Original
authentic software CD with Manual on CD itself & free live Updates for
full 1 Year. So practically you will get everything except box at the
fraction of the cost.
Looking at this again, I can't help but think maybe this software
has been installed somewhere else, and this guy's just selling off the
retail CD. But, is it my responsibility to make sure of this? As a
generally tech-savvy guy, should I look at the financials (less than
10% of the retail price) and know that this isn't legit?
I don't want to contribute to software piracy, and I don't want to
cheat a company out of their money. But if the seller assures me that
everything is on-the-level, and the only warning alarm is a
really, really low price, am I in the clear legally? How about
ethically?

01/05/2004 04:56 AMThe latest in bizarre patent applications is a business model patent
being applied for by JP Morgan for the
concept of buying underwater stock options. How is this
patentable? That's unclear, but the folks at JP Morgan think they've
hit onto something. They think that many companies trying to help
employees get rid of underwater options may sell them to Morgan -
following Microsoft's lead (where Microsoft let employees
switch
over from stock options to restricted stock). Of course, now that
the economy is starting to pick up again, companies (and their
employees) may be more interested in holding on to their options.
Either way, it doesn't explain how making a risky investment is
patentable. It's certainly not an original idea. I remember
discussing just such a business model with some people in 1998 - when
we knew a few people who had left jobs where their options were
underwater, and who had no interest in buying them. Of course, we
realized that the risk of buying underwater options on a regular basis
meant that it could be quite difficult to ever actually
make
any money - but the folks at JP Morgan are betting the market is
turning around and are hoping to buy up now before anyone realizes it.

of his sons to
stop using Kazaa and start using iTunes or
Rhapsody. He admits that it's really pricey for limited
selections, but feels more comfortable about it. He's also surprised
that in letting his son download music, he now wants to
buy more
CDs. Despite the music industry claiming that no one would ever
want to buy CDs if they could download music (especially teenagers!),
the reporter's son wants the CDs because they come with liner notes
and lyrics that make it worthwhile. Again, this is an example of the
industry missing an opportunity. People (including myself) like to
own the actual CDs if it provides us with additional value. At the
same time, downloading music can help people figure out what CDs they
want to buy.

certainly not limited to the government sector. Ford is now admitting
that they're
dumping an internet purchasing system they bought from
Oracle
four years ago, after being unable to make it work with
existing systems. Luckily, they kept the legacy system running, so
they're just switching back to that. What's scary is that these
stories don't seem that far off the norm. Almost everyone seems to
have stories of multi-million dollar enterprise software systems that
don't work.
