The FCC has been cracking down on supposedly indecent broadcasts (and
chilling free speech) ever since Bono was really impressed by the
Golden Globes and Janet had her malfunction. Under the current rules,
in order to send in an indecency complaint, the complainer had to
provide a "tape, transcript or significant excerpt." Broadcasters
weren't required to maintain copies of a show, so complaintants faced
a minimal burden to complain. However, now the FCC is going to require
broadcasters to maintain copies of broadcasts for 60-90 days. They are
considering letting people issue complaints with no evidence (since
the broadcaster will be able to produce the tape), and if the
complaint is late (after the 60-90 days) broadcasters can still be
hit. This will really open the floodgates to indecency complaints.

In all the discussions over wireless spectrum, the elephant in the
room continues to be the incredible amount of spectrum TV broadcasters
have had for years, given to them for free, which they don't want to
give up. The spectrum was originally given to them to get them to
move to digital broadcasts, but it was set up in a way that made it
easy for the broadcasters to hang onto the spectrum for as long as
they wanted: until 85% of the country had equipment to receive digital
broadcasts, the broadcasters could keep the spectrum. In other words,
all of the incentives were for the broadcasters to drag their feet --
which is exactly what they've done. Now John McCain is trying to push
the issue by
allocating $1
billion to help more people get digital receivers for their TVs.
While a billion seems like a lot, it's nothing compared to what the
freed up spectrum is likely to be worth in a variety of ways. Some of
it is likely to be auctioned off for
a lot more than $1
billion, and other portions can (hopefully) be opened up for open
spectrum purposes, which should drive a variety of new wireless
technologies, services and applications. The spectrum situation with
the broadcasters is a complete mess. At this point, just about
anything to get some of that spectrum back from the broadcasters seems
like a good plan.

Energy traders who chortled (CBS) over the screwing their company was giving
California and other western states in the 2000 energy crisis are
amazing mostly for their brazen quality.
Still, if California's political leaders -- from both parties --
hadn't made such a mess of deregulation, the crooks from Enron and
other companies never would have had the opportunity in the first
place. That doesn't excuse them, any more than a burglar is excused
for entering a residence where the owner forgets to lock all the
doors.
Someday we'll know who Cheney's energy buddies were -- the ones he's
trying so hard to shield from the public. The only surprise will be if
Ken Lay and Jeff Skilling aren't among them.

Joe Bussard has 20,000 vintage 78
rpm records from the 1920s and 1930s in his basement. For $15, Joe
will put together a custom cassette compilation for you of 20 tunes
from his collection, perhaps the largest of its kind in the world. I
wish Joe and his friends would rip all of his 78s so he could sell MP3
CDs of these ultra-rare recordings. Here's a great NPR All Things
Considered piece on Joe Bussard from last year.
"'The truest form you'll ever hear in American music is on
these records,' Joe says. 'It was put there, and it's remained there
for seventy years. It hasn't changed.'"

reel-to-reel tape deck at the outdoor music festivals prevalent in the
vast rural area that previously surrounded Washington."
NPR's Morning Edition did a piece on Kagarise last summer. He's
working with Joe Lee, a friend and local record store owner, to sell
the recordings. Not surprisingly, the Library of Congress, the Country
Music Hall of Fame, and others are apparently interested.
"You know, these [performers] were people from the
mountains and from the rural South," Lee told NPR. "And once they were
put in a studio, and they had a producer looking down at their snoot
at the guy. And an engineer telling them, 'Well, if you make one
mistake, we have to stop and start all over again.' It lost the
atmosphere. It's like trying to play guitar in a straightjacket on...
It's sort of like being in the zone. When you're really at ease, when
there's no intimidation factor, then it really soars. And the proof is
in these tapes here."
I hope someone releases a "best of" box set!
