Curious Labs on Friday unveiled Shadow Catcher, the first new feature that will be included in Poser 6 when it's released sometime this spring. Shadow Catcher makes 3D image composition easier by enabling artists to render shadows independent of background surfaces. It integrates with Poser 6's new lighting features, which will be unveiled at a later date. The developer, which has not released an exact ship date nor pricing, will continue to reveal new features in the coming months. A product page is not available yet on the Curious Labs Web site.

Curious Labs Inc. on Tuesday announced that it is now shipping Poser 6, the latest version of its 3D tool for creating realistic human figures. New features in this upgrade include a revamped user interface, OpenGL hardware acceleration, cartoon outline rendering effects, better support for Flash with user-defined export colors for the Web and more. Poser 6 also offers two new lighting tools: ambient occlusion, which creates photorealistic soft shadows, and image-based lighting, which uses a photograph or an image map to light 3D scenes and make them appear as if they're part of a real-world environment.

The latest in the Eolas patent saga is that someone at the Patent Office has finally agreed to review the patent based on stacks and stacks of prior art that people have been finding. Amazingly, the Patent Office appears to have responded quickly (though, they don't say how long it will take for a new decision on the patent) to the requests for a re-examination of the patent. There's a quote from the USPTO's deputy commissioner for patent examination policy saying that this was an "extraordinary situation" which necessitated the quick response. The problem with this statement is that it's not an extraordinary situation. In fact, it's an increasingly common situation, where silly patents are getting the stamp of approval every day - and then used to hold other companies up for extortion, rather than for encouraging innovation.

I think it's about time we came up with a new topic/icon for stupid patents. There are just so many of them these days. The latest is that Adobe, who is no stranger to abusing intellectual property rules, is now being hit with a patent over their PDF technology. The patent is for a method of extracting network information via hyperlinks. Reading through the patent, they're basically describing a system for clicking on a hyperlinking and having the system not only download the page in question, but all locally related pages linked from that page as well. Perhaps a useful system, but it seems like this sort of technology was around well before the patent was granted, and it's unclear what it has to do with PDF files.

Richard C. Jaworski announces that the US Patent Office has granted his “Petition to Make Special” on his System of Testing the Upstream Cable Modem Channel (TUCMC) patent application. The petition to the US Patent Office alleged infringement of his technology by Acterna Corporation in their DSAM 2500 Cable Modem Test Instrument. Mr. Jaworski has written evidence that Acterna knew of the patent and the technology prior to releasing the feature in the DSAM 2500. According to patent law, triple damages are applicable for prior knowledge infringement as soon as the patent issues. MSNBC is running yet another article that looks at problems with the patent system, focusing on the problem we most discuss around here: small intellectual property houses that buy up perfectly obvious patents, or those with prior art, and then go around threatening small sites to get them to pay up rather than fight the ridiculous patent. In most cases, the patent is for taking some sort of obvious action and moving it onto the internet. Even a strong defender of patent rights admits in the article that the "pendulum may have swung too far." No one is saying their shouldn't be patents, but there are way too many cases where these sorts of patents are clearly being used to hold back innovation - which is against the very point of the patent system.

The patent office finally got one right (though, it took quite a while). Despite tons of prior art, and a patent that was far from "non-obvious", Eolas convinced a judge to award them over half a billion dollars from Microsoft for using embedded applications within IE. Microsoft started talking about changing the browser in a way that would have broken many web sites. After quite a bit of outcry from many different places, the patent office finally agreed to review the patent, and on second thought, are now rejecting the Eolas patent. Did it really need to take this much time, this many lawyers and this much outcry just to get a single bad patent reviewed and rejected? Isn't it about time we fixed the patent system?

Some years ago, a collegue of mine asked me how I would stop music pirating.  I haven't thought about the problem before but it took me only a minute to decide P2P spoofing was the best intermediate answer.  It was obvious that traditional DRM wouldn't work and spoofing attacked the problem at reasonable cost, could be deployed fast, and adapt to changes in real time.  My collegue nodded and that was that.

According to Wired, someone had the exact same idea and filed a paten t in 2000.  Now I am scratching my head.  Is this a silly patent or not?  Should I be filing patents on similar ideas?  Heck, I can pump out enough ideas like that everyday to keep an army of patent lawyers busy if someone would just keep throwing problems at me and file my answers as patents.  I even have ideas on how to efficiently generate new patents.  Maybe I'll even best IBM at the game.

If you are an idle patent lawyer, come to me and I'll keep you busy.  How does 50-50 sound?  Filing cost?  No problem.  Let private investors place 'bets' on the patent applications they like out of daily streams of patent applications.  Together we'll worsen the patent problem ten-fold within a year and force the Congress to come up with a better solution.  Now that's a silver-spoon full of patriotism for ya.  :-)

I found out last Friday that the Phishmark idea is likely to be covered by a patent filed by PassMark two years ago.  Although I haven't read their patent application yet, discussion with Louie Gasparini, CTO of PassMark, made it clear that the broad languages used in the patent covers not just use of user/site specific visuals on the webpages for website authenticity, but also use of user/device-specific visuals in client-software for verification of UI authenticity.

Since I never planned to patent Phishmark and have many other ideas to pursue, I am not planning to disputing PassMark's patent.  If you have planned to use Phishmark in your product already, I advise you to talk to PassMark.  I am sorry if this turn of event affects your product.  As for me, I'll have to credit one of my clients for the hours I spent implementing it.

Does this upset me?  Not really.  Anyone can have ideas and I have more than others.  Execution is important too but I care more about people and how ideas affect their lives.  Phishmark was a good idea, but someone else had a similar idea and had the courage to follow through.  Yes, the situation is rather awkward, but not uncommon.

As they say, if your pants are uncomfortable, keep walking.

The coverage from ZDNet says the patent is for the conversion of objects into XML files; but if you read the patent itself, the important “Claim 1” doesn’t even mention XML, it’s just about serializing objects based on using an annotated source file and a schema. I was trying to find a way to write about this without becoming shrill and using bad language, but failing. Fortunately, I ran across a good opinion, shrill but not obscene, penned by Greg Aharonian who’s a real actual patent lawyer and thus qualified.
