Fireworks for free
08/07/2004 10:55 PM

Last night I went to see fireworks. There were approximately 22,000
fireworks ignited and an expected turnout of about 320,000 people. You
could pay 30,000 yen (around 300 dollars) and get a special seat as a
sponsor. Otherwise, you could, like the 320,000 or so other people,
find a nice spot and watch the fireworks for free. In fact, there were
two other fireworks festivals (Japanese love fireworks) going on
within view of the nice spot in the park that we had chosen.
Fireworks shows in Japan are sponsored by companies and local
governments. The sponsors usually get the best seats and they are
thanked over the PA system for the people watching the show up close.
For 99% of the people who watch the fireworks from far away, the
sponsors are invisible. These people are, to use Hollywood's favorite
word, "stealing" this content. They don't view ads, they don't pay.
They do consume a lot of beer, buy stuff in local shops which pay
taxes and generally feel good about the "public good" they've just
been a part of. Like me, they take pictures and videos of the
fireworks and post them to the web and send them to their friends.
I wonder if there is some sort of equivalent business model for
other content businesses. Charge a small number of people a large
amount of money and give it to 99% of the people for free. Get
sponsored by companies and other organizations like local governments
that benefit from the secondary consumption increase and follow-on
derivative works creation and sharing.

Safer, Quieter and More Environmentally Friendly Fireworks
Technology: Disney has sort of open-sourced a new way to launch
fireworks. The new method uses compressed air instead of black
powder. (The quote below is from a press release, so it's a little
self-serving.)
As a recognized industry leader and the world's largest
producer of fireworks shows, Disney is in the process of donating all
seven patents associated with the new air launch technology to a
non-profit organization so these patents can be licensed to other
pyrotechnic providers.
The bit on CNN said that Disney hopes other companies will use the
technology and improve it. sounds a lot like open source, though I
don't know if the improvements to the technology need to be donated
back to the organization or not.

the line was too long - and the line for "gourmet" coffee was even
longer. Still, I had a great time with my sweetheart. Jack Skellington
memorabilia was all around (thanks to the Haunted Mansion redux), so I
had to empty my wallet before leaving. $80 of it went to two jackets
that would help keep our underdressed bodies warm in the evening
hours. And since LEGO had an Imagination Center in Downtown Disney, I
was also able to get a Darth Vader figurine to aid in the completion
of my freshly-formed (out of the package) collection. Next year,
perhaps I'll pick a slightly more secluded place to share time with
that certain someone?...

America from the Statue of Liberty to
Guantánamo
06/05/2005 11:33 PMIt still amazes me that in 4 short years, George Bush has managed to
transform the symbols by which America is known overseas from the
Statue of Liberty and Hollywood to Guantánamo and the hooded prisoner
tortured at Abu Ghraib. Each day brings new evidence confirming the
reports of American murders and atrocities committed in the name of
the so-called "war on terrorism," which seems to have turned into the
"war to create terrorists." For instance, Human Rights Watch reports:
at least six detainees in U.S. custody in Afghanistan have been killed
since 2002, including one man held by the CIA. More than two years
later, no U.S. personnel have been charged with homicide in any of
these deaths, although U.S. Department of Defense documents show that
five of the six deaths were clear homicides. While the Bush
administration denies any responsibility for the atrocities, blaming
low level soldiers for having correctly understood Bush's orders
condoning torture, Guantánamo has come to symbolize the United States
for large parts of the world. As the NYT reports: From Mumbai, India,
to Amman, Jordan, to London, Guantánamo is a continuing subject for
discussion, from television talk shows to sermons to everyday
conversations. In countries like Afghanistan, Britain and Pakistan,
released detainees often return home and relate their experiences on
television news programs. Accusations of egregious abuse sometimes
prompt violence, as in last week's demonstrations in Afghanistan.
Guantánamo provides rhetorical fodder for politicians seeking to bring
down United States-allied rulers in their own countries, and it offers
a ready rallying point against American dominance, even in countries
whose own police and military have been known for severe violations of
human rights. ... In Europe, accusations of abuse at Guantánamo, as
much as the war in Iraq, have become a symbol of what many see as
America's dangerous drift away from the ideals that made it a moral
beacon in the post-World War II era. There is a persistent and uneasy
sense that the United States fundamentally changed after September 11,
and not for the better. What can I say to the parents of the 654 young
men being held and tortured by American soldiers in Guantánamo and
Bahgram, many of whom appear to be guilty only of being Islamic in the
wrong place and wrong time? For a man raised with the idealism of the
Civil Rights movement, the anti-war movement, and the Peace...

04/29/2004 09:19 AMNY Times: Court
Hears Case on U.S. Detainees. The Bush administration yielded
no ground before the Supreme Court on Wednesday in arguing that the
open-ended military detention of United States citizens as enemy
combatants, without criminal charges or access to lawyers, was
justified both in law and as policy.
The
administration's claim here -- that the president and his aides alone
can decide to lock an American citizen away forever is a claim to
their right, and that of future presidents', to be tyrants.
It's incredible that this is even thinkable. But our collective fear
from the Sept. 11 attacks, and Congress' absolute spinelessness in
defending the Constitution it swore to uphold, has given Bush what he
so plainly wants: the opportunity to be the president who asserts, and
gets, absolute power.
Absolute power is
always abused. Always. This kind of
absolute power -- making leaders the prosecutor, judge and jury -- is
the lynchpin of tyranny.
If the court upholds this abuse of liberty, it will be assisting in a
crime: If this assault on the Constitution succeeds -- if the
Constitution has truly become meaningless on something so fundamental
-- then we will have destroyed America to save it.
The stakes are that high.
NOTE:
Slate's
coverage of the court arguments yesterday has a smart additional
feature. There are inserts linking to the audio of specific

06/28/2004 09:35 PMNY Times:
Supreme Court Affirms Detainees' Right to Use Courts. The
Supreme Court ruled today that people being held by the United States
as enemy combatants can challenge their detention in American courts
— the court's most important statement in decades on the balance
between personal liberties and national security.
There's still a scary deference to the executive branch
in some of the language in these rulings. But there's also something
to cheer: the president can't decide what the law is.
The court punted on the Padilla case. He's an American citizen who was
grabbed on U.S. soil and slammed indefinitely into a military brig.
The court said his lawyer raised the case in the wrong court. Sheesh.
But there's overall good news. As one justice wrote, the "War on
Terror" does not give the president "a blank check" in defining the
rights -- or lack of rights -- the Constitution grants.
