Microsoft argued their claims pre-dated those of TypeRight Keyboard Corp. Then, in a twist of events, the US Court of Appeals for the Federal Circuit in Washington DC said there was "genuine issue" with the credibility of a Microsoft witness. Bottom line, the invalidity judgment was improperly granted. Next step, trial and lots of billable hours by lawyers." The article is pretty sketchy on details, but it certainly appears to imply that someone fudged the prior art proof.

A trial date has been set in a major patent infringement case involving 41 major hardware and software vendors, including Apple and Dell, and a company claiming the rights to an algorithm used in the JPEG picture file format. Austin-based Forgent Networks Inc. and its wholly-owned subsidiary Compression Labs Inc. are suing 41 companies for allegedly infringing on the JPEG-related patent for digital image compression. The patent has garnered about $100 million for Forgent in licensing fees during the past three years. In use since the mid-1980s, the JPEG, or Joint Photographic Experts Group, format has become standard for sharing photo-quality images electronically. Although the most widely used version of the format is in the public domain, Forgent said it believes that a 17-year-old patent it acquired through the purchase of Compression Labs in 1997 can be applied to a specific algorithm in the format. According to the Austin Business Journal, pre-trial proceedings are scheduled to start April 28 in East Texas, with a jury trial to begin in October. News of the trial date this morning sent stock for Forgent Networks Inc. soaring to a 34 percent increase to $2.75 per share.

Sony has been ordered to pay over $90 million in damages over a patent infringement lawsuit and was also issued a permanent injunction against the manufacture, use, sale, or import into the U.S. of PlayStation consoles, Dual Shock controllers, and 47 games that infringe on the patents. Immersion Corporation was awarded $82.0 million in past damages, along with pre-judgment interest in the amount of $8.7 million by the court for the technology Sony used that makes a game controller vibrate in sync with actions in games. Sony's gaming unit, Sony Computer Entertainment, plans to appeal the decision made by the California court on Thursday.
