06/10/2004 03:09 AMLast month, L.L. Bean decided to go one step further from suing Claria
for putting pop-up ads over the browsers of Claria users when they
visited the L.L. Bean website and
sued
the advertisers whose ads showed up. At the time, we pointed out
that this was ridiculous. Putting those ads there is no different
from someone buying a billboard in front of a competitor's office,
which is a practice many companies do. The
real problem with
Claria (and it
is a problem) is that the software gets
installed without users knowing it. However, if a user
does
want Claria's Gator product running (and, amazingly enough, some
people do want it), that's their decision. There is no law that
someone can't use software that pops up advertisements when they visit
someone else's website. After realizing that their advertising
customers were upset over these lawsuits, Claria has struck back and
sued L.L. Bean for filing frivolous
lawsuits. Of course, their reasoning isn't so much that these
actions are perfectly legal - but that some of the companies sued are
no longer Claria customers (which could mean they'll turn around and
sue Claria back for causing them to get sued - some lawyers are likely
reviewing indemnification clauses as we speak). Either way, this is a
big legal mess over the wrong issue. What Claria is doing with their
ads is perfectly legal. What they're doing with the installation of
Gator, however, is a much bigger question - but none of the lawsuits
focus on that.

actresses in this year's Toronto benefit performance of The Vagina Monologues last weekend.
It's outrageous and funny, and not nearly as shrill in its feminist
message as detractors might have you believe. The performances
are synchronized around Valentine's Day across North America and
beyond, to support various local not-for-profit organizations fighting
to end violence against women. The coordination is done under an
umbrella organization called V-Day: Until the Violence Stops. Their
website descibes some of the excellent work V-Day has done, especially
in Mexico and Pakistan. It also describes the pathetic attempts of the
Catholic Church to prevent showings of the Monologues on Catholic campuses. If
you haven't seen it -- check it out. It's a noble cause, and a great
show.
Monday is also International Women's Day,
but there are surprisingly few events scheduled. This at a time when
the rights of women are under unprecedented assault by the patriarchal
religious right, when governments are slashing and even eliminating
investment in social programs, and when big business is eliminating
and
exporting jobs to third world countries where women and girls toil
long
hours in sweatshops under intolerable conditions for starvation wages.

hackers mounting an all-too-common class of attack—the SQL injection
attack.
The basic idea behind a SQL injection attack is this: you create a
Web page that allows the user to enter text into a textbox that will
be used to execute a query against a database. A hacker enters a
malformed SQL statement into the textbox that changes the nature of
the query so that it can be used to break into, alter, or damage the
back-end database. How is this possible? Let me illustrate with an
example.

Looks like all those pastel
PSPs Sony was showing at E3 were just a tease. According to an
interview in Japanese game magazine Famitsu, Sony claims the
various color PSPs were "just for reference. We plan to make the
system black." I wouldn't worry too much, though. I'm sure if the PSP
does well at all, color models will start showing up in no time at
all.

No one who has read The Boondocks
has a neutral opinion about its writer, Aaron McGruder. You either
love
him or hate him, or vacillate between the two extremes. The
twenty-something radical leftie is working on a Simpsons-style
animated
series that will air, ironically, on Fox, probably next year, and as
the New Yorker reported last
month,
he's managed to outrage almost everyone of every political stripe,
including other cartoonists who say that he's gotten lazy (the strip
is
now drawn by Jennifer Seng, though McGruder still does the writing),
and that he's relentless to the point of being tedious and unfunny. He
is the most banned cartoonist in history, with many of the 300+ papers
carrying the strip having cut it at one time or another. But as I
think
the above strip from last week shows, McGruder's biting wit has lost
none of its edge, and demonstrates a fearlessness that goes beyond
even
what Doonsbury and Bloom County achieved.
