Another day gone by and another story about some company claiming a random patent concerning a business they're not even in. In this case, it's a patent from the same company that has managed to squeeze a ton of money out of companies by claiming to own a patent on the compression of images used in .jpg images. Now they claim they hold a patent on the concept behind DVRs, thanks to a vague patent that talks about recording TV signals on computers. Once again, you have to ask two important questions: how is that non-obvious enough to deserve a patent? It was a clear evolution of the technology. Second, why do we allow the patent system to work this way when it's clearly not rewarding innovation at all, but actively punishing those companies that innovate? Meanwhile, with TiVo building up their own patent portfolio, it looks like we'll have yet another paten t cold war involving all of this nuclear stockpiling. At what point do people realize that the system is broken? It's not encouraging innovation. It's just making some patent lawyers wealthier while taking money out of research and development of new, innovative products.

I continue to make calls to operators and vendors that could be affected by this patent and generally find companies reluctant to talk about the issue. Many of them say that they believe many companies had redirection before Nomadix filed for the patent and as such the patent shouldn't be enforceable; this is called "prior art." But I suspect that few want to actually be the company that challenges the patent. They're likely waiting to see if Nomadix goes after them. My impression, based on the fact that I continue to feel like I'm informing companies of the patent, is that Nomadix hasn't yet approached vendors or operators that it feels are infringing on the patent. There are some companies supportive of Nomadix, however. STSN licenses the Nomadix redirection technology and believes others should too. "The Wi-Fi industry will come to a grinding halt if we don't support the private ownership of IP [intellectual property]," said David Garrison, STSN's CEO said in an exclusive interview today. Plenty of people have started to realize that, instead of encouraging innovation, many are using the patent system as a sort of legalized shakedown. Software patents are bad, but business model patents are downright scary. The SCO Group Inc. said Thursday that Microsoft Corp. was not involved in raising venture capital funding for the company, dismissing claims that a leaked e-mail demonstrated that Microsoft had helped raise tens of millions of dollars for SCO. An e-mail from an outside consultant to SCO apparently involved in brokering deals for the company was posted to the Open Source Initiative Web site Wednesday. The consultant in the e-mail suggests that Microsoft "brought in $86 million" for SCO and that between US$16 million and $20 million is underway.
