Canada Rules That ISPs Don't Need To Pay
Royalties For Subscriber Downloads
06/30/2004 11:25 AMWhile some Canadian
politic
ians seem a bit shady when it comes to understanding the
intricacies intellectual property law, it appears Canadian judges are
doing pretty well. First, they
shot
down lawsuits against file sharers by pointing out that the
recording industry didn't actually have any
evidence that files
were uploaded or downloaded (just that they were "available"). Now,
they've ruled that ISPs are
not
responsible for paying royalties when their subscribers download
music. This was part of a money grab strategy by the
entertainment industry who figured that they might as well just go
after ISPs and see if they could get some cash out of them. The
Canadian Supreme Court, in a unanimous ruling, found that ISPs are
just "intermediaries," and should have no obligation to pay for what
their subscribers are doing.

Lawsuit Over Whether Napster's Investors
Are Liable Heading To Court
04/20/2004 07:35 PMIn a case that could have serious implications for venture capitalists
and other investors in companies, the lawsuits that
Univers
al Studios and
EMI
filed last year against Napster's investors (including their own rival
label Bertelsmann) have been combined into one case that is
set to get under way
next week. The two labels accuse the investors of being
responsible for copyright infringement by keeping Napster in business
longer
and for inspiring "copycat" sites like Kazaa and
Morpheus. Beyond the basic problem that (again) they are blaming the
tool and not the actual illegal action, this also opens up a whole can
of worms concerning any investment. The investors simply invest in
the company, and while they may have some influence over what the
company does, to blame them for illegal actions performed by users of
a product seems to go well beyond reason. That's like saying we
should blame investors in Ford if a Mustang is used to run someone
down. It's going beyond blaming a tool that was misused and even
beyond blaming the company or its management for creating a tool that
could be misused, all the way towards blaming those who kept the
company in business with their money. Clearly, without Ford's
investors, the company would never be where it is today, and no one
would be able to have Mustangs to run over others. Therefore, they
must be guilty of manslaughter by association. In fact, why not take
it one step further. Perhaps all of Ford's customers should be
responsible (even if they only did legitimate actions with their
vehicles) because they put money in Ford's bank account letting them
stay in business as well. The argument is ridiculous and hopefully
the judge will see it the same way.

05/05/2004 12:52 PMRecord companies love to make a big deal about how file sharing
deprives artists of their royalties. Too bad the record companies
themselves must be forced, by court order, to pay the royalties they
owe to artists instead of keeping it for themselves.
A two-year investigation by New York state Attorney
General Eliot Spitzer's office found that many artists were not being
paid royalties because record companies lost contact with the
performers and had stopped making required payments.
The artists that were too hard for the record companies to find
include unknowns such as Sean Combs, Gloria Estefan, and Dolly Parton.

Dems on the Supreme Court
Dems on the Supreme Court
01/11/2004 07:56 AMSo an underplayed aspect of this campaign has been how the Democratic
candidates would differently select the Supreme Court. On NPR's
debate
, Senator Lieberman pointed to Justice Souter as a model. Congressman
Kucinich plugged Justice Ginsburg. I've gotten a couple pings asking
what the right answer is.
Hard question for me. Of course neither Ginsburg nor Souter were on
the correct side (or the right side) of Eldred, but I certainly think
Justice Souter is a model justice -- serious, hard working, unburdened
by ideology, prepared. I never quite get the principle that guides
Justice Ginsburg's choice between activism and not, or principle and
not, so I'm waiting to see the genius in that selection by President
Clinton.
Justice Breyer of course wrote a brilliant dissent in Eldred --
brilliant, though not effective. He was
proud of the decision's embrace of economics as the standard by which the
Sonny Bono Act was judged. But while I'm a fan of the result, I've
been too deeply affected (scarred?) by the
originalism/textaulism/fidelity theories of Scalia to be enamored of
that method.
In my view, perhaps the best sitting justice is a Republican appointee
-- Stevens. And if candidates are looking for what makes the best the
best, then it is certainly his judges' judge-like character. There's
no simple line that predicts Justice Stevens' result -- certainly not
a political line. And if there is any quality this Court needs, it is
that -- following a line that does not seem a political line.
The most impressive judges not sitting on the Supreme Court are also,
um, Republicans. (What party am I again?) Judge
Kozin
ski is a great judge -- too young when appointed, but someone who
has matured brilliantly in the job. And while his views about how to
the interpret the constitution make me cringe, history will record the
greatest judge of our time as Judge
Posner. But I
doubt that this is the time that a President from either party will
pick greatness as the reason to select a Justice.
