Enter the Patent Busting Contest!

The Electronic Frontier Foundation's Patent Busting Project is here to protect you from dangerously bad patents. And you can help us pick which patents we're going to bust first!

We're currently seeking nominations for ten patents that deserve to be revoked because they are invalid. Sadly, we don't have the resources to challenge every stupid patent out there. In order to qualify for our ten most-wanted list, a patent must be software or Internet-related and there must be a good reason to suspect that the patent claims are invalid. We're especially interested in patents that target tools of free expression, such as streaming media, blogging tools, and voice over IP (VoIP) technology. Most importantly, the patent-holder must be aggressively enforcing its patent and suing (or threatening to sue) alleged infringers. We're particularly interested in cases where the patent-holder is trying to force small businesses, individuals, nonprofits, and consumers to pay licensing fees. Deadline to enter is June 23.

On June 30, the Patent Busting Project's team of tough lawyers and brainy geeks will announce the contest winners – or losers, depending on how you look at it. And that's when the real fight for great justice begins. We'll be needing your help to research prior art for each patent and offer your technical expertise or historical knowledge. Using a legal process called "reexamination," the Patent Busting Project will ultimately go to the US Patent and Trademark Office (USPTO) and attempt to take those bad patents off the books.

My cow-orker Jason Schultz made the NYT this weekend in a piece about EFF's fight to bust crappy Internet patents. My favorite bit of the article is this bit of deadpan juxtaposition:

Another patent on the foundation's list covers a way to make telephone calls over the Internet. Mr. Schultz said the company holding that patent, Acceris Communications of Toronto, had drawn the group's attention by filing an infringement lawsuit against a relatively small service provider, ITXC, rather than larger companies like Vonage Holdings. Small companies rarely have the resources to fight infringement suits, Mr. Schultz said.

The president of Acceris, Kelly D. Murumets, rejected the charge that the company was pursuing only small rivals.

"Acceris has not targeted smaller players," Ms. Murumets wrote in an e-mail message. "In point of fact, and only after offering a license, Acceris filed a lawsuit against a major player" in the industry, ITXC.

Last month when it was announced that the RIAA was hiring the former head of the ATF, I joked about how the copyright cops might soon be busting down your door. What I didn't realize was that it's no joke, and it's already happening. Found on Slashdot is the news that the RIAA has been hiring ex-law enforcement officials, outfitting them with police-style outfits, including black "raid" vests with yellow lettering stenciled on the back to spell RIAA, and sending them out to scare unauthorized vendors of CDs and confiscating what they find. While I have no sympathy for those selling such CDs, this does seem to go well over the line. The RIAA claims that it's very effective, and they don't mean for the vendors to actually think they're police - but the effect suggests otherwise. In that case, you could make the argument that they're falsely impersonating law enforcement officials and stealing the CDs they take. They do make the vendor sign an "incident report" indicating that confiscating the CDs is "voluntary" - but if you're scared to death you're about to be arrested, it doesn't seem very voluntary.

If you've been developing for Windows for (n+1) years, you might consider venturing into open source software development a daunting prospect. Reading the Free Software Foundation Web site makes it look like all development is done in straight C -- of course there's no Visual C++ or Visual Basic. Linux doesn't have its own component model and there is nothing even remotely like DirectX for low-level hardware access. It's just too hard for the dyed-in-the-wool Windows developer to program for Linux.

Recently we wrote about the trend of virus writers shift ing their efforts to spyware -- same thrill, more money. Another story today contradicts the theory that these scofflaws are a bunch of ne'er-do-well capitalists, or at least most of them. Rather than profit-seeking, most viruses are written for the challenge with little regard for the ultimate impact. Or so says Symantec expert Sarah Gordon, who has apparently interviewed hundreds of malware writers over the years. (Why Symantec has an employee dedicated to studying virus-writer psychology is another topic altogether.) Another misconception she's found: her interview subjects often have significant others -- deflating that old stereotype of lonely, loveless nerds. Rather, they vary considerably in their social and demographic profiles. Maybe you can't trust every assumption about virus writers. Next thing you know, we'll find out they don't have computers either.

The latest in the Eolas patent saga is that someone at the Patent Office has finally agreed to review the patent based on stacks and stacks of prior art that people have been finding. Amazingly, the Patent Office appears to have responded quickly (though, they don't say how long it will take for a new decision on the patent) to the requests for a re-examination of the patent. There's a quote from the USPTO's deputy commissioner for patent examination policy saying that this was an "extraordinary situation" which necessitated the quick response. The problem with this statement is that it's not an extraordinary situation. In fact, it's an increasingly common situation, where silly patents are getting the stamp of approval every day - and then used to hold other companies up for extortion, rather than for encouraging innovation.

I think it's about time we came up with a new topic/icon for stupid patents. There are just so many of them these days. The latest is that Adobe, who is no stranger to abusing intellectual property rules, is now being hit with a patent over their PDF technology. The patent is for a method of extracting network information via hyperlinks. Reading through the patent, they're basically describing a system for clicking on a hyperlinking and having the system not only download the page in question, but all locally related pages linked from that page as well. Perhaps a useful system, but it seems like this sort of technology was around well before the patent was granted, and it's unclear what it has to do with PDF files.
