The United States Supreme Court ruled in favor of retaining the 1998 Copyright Term Extension Act ( CTEA ). The CTEA extended the lifetime of copyrights to 95 years past the moment of publication. According to the majority opinion in the 7-2 ruling, Congress acted within Constitutional bounds five years ago, when it added to preexisting terms for copyright ownership. Dissents from Justices Breyer and Stevens argued that the law's practical effects were deleterious to public culture.

The decision represents the end of one battle in the copyright struggles. It stands as a victory for several intellectual property (IP) holders' groups, such as the RIAA and MPAA , perhaps signalling an era of effectively perpetual copyright . It's a defeat for litigants and supporters like Web publisher of public domain works Tim Eldred , and Stanford cyberlaw professor Lawrence Lessig .


For students and educators, the fallout is complex, although the decision changes no law. As consumers of intellectual property, we must continue to be vigilant about seeking permission for IP that has not yet fallen into the public domain. As IP producers, we continue to retain ownership for nearly a century.

Today, America's highest court ruled that a law intended to punish child pornographers is an unconstitutional restriction for online free speech.
The high court divided 5-to-4 over a law passed in 1998, signed by then-President Clinton and now backed by the Bush administration. The majority said a lower court was correct to block the law from taking effect because it likely violates the First Amendment. The American Civil Liberties Union and other critics of the law said that it would restrict far too much material that adults may legally see and buy, the court said. "Today's ruling from the court demonstrates that there are many less restrictive ways to protect children without sacrificing communication intended for adults," said ACLU associate litigation director Ann Beeson in a statement. Beeson argued the case before the court in 2001 and again last March.

When the FTC first announced that all porn spam would need to be labeled with "sexually explicit" in the subject line, we noted that they were now legaliz ing porn spam and that we should expect plenty of it. A new study shows that not only has the amount of porn spam increased since that rule went into effect, most porn spammers are ignoring the law in one way or another. It looks like many did try to put "sexually explicit" or some related misspelling in the subject line, but then ignored just about every other part of the law (such as no spoofing of the from address). Of course, it was just Monday that we pointed out that porn spam was fading as an overall percentage of spam. However, that should give you an idea of how much overall spam is increasing. While the absolute number of porn spam messages has jumped, the relative percentage in relation to financial and other spam messages is decreasing. And, to think, our politicians told us that by now we'd be living in a post-spam world thanks to CAN SPAM.

Wait just a second. A month ago, we were hearing stories from our elected officials about how spam was supposed to be dead dead dead by now, thanks to the "CAN SPAM" law which would make it illegal to spam. Of course, as we all know, the law wasn't really intended to stop spam at all, but rather to give instructions on how you can spam. Further evidence of that comes today as the FTC is actually releasing new rules for porn spammers on how to spam. They're telling them they need to include a special label. In other words, they can just keep on spamming - as long as they include that one little label. Great way to "stop" spam, huh?

UK tabloid The Sun is reporting that 227 UK Civil Servants in the Department for Work and Pensions (DWP) have been disciplined for downloading pornographic images whilst at work. The Sun reports that some 2 million images were viewed, as well as some involving child pornography / abuse. Of the 227, 16 were sacked, one has been prosecuted, and the rest have been able to continue their jobs at the Government department.

Liberal Democrat Steve Webb (Lib Dem DWP Spokesperson) believed that the government should introduce a 'zero-tolerance' policy across all departments when it came to pornography. "Any public servant who accesses porn sites at work should lose their jobs" Webb commented.

A spokesperson for the DWP said that regular checks took place on staff computers for pornography; any staff caught would be investigated. However, they also commented that many investigations into pornographic material was due to staff inadvertently clicking a link that brought them to the page, rather than an intentional action. The Sun claims the most recent check was sparked off after a DWP employee was caught watching porn at work.
