It's unfortunate that companies still feel the need to equate patents to "innovation" when the opposite is often true. These days, unfortunately, many companies feel the need to get patents simply as a defensive measure. Whether for defense or offense, it appears that Bill Gates believes Microsoft needs more patents. The company is ramping up their efforts to file for more patents and plan to extort license them to other businesses. So far, they're off to a good start. Some recently noted Microsoft patents include savin g the name of a game you're playing, showing that someone is "typing a message" in IM software, threa d based email, writing an application in HTML, groupin g programs together in the taskbar, pronoun s used in programming and the concept of giving "kudos" points for style and flair. Well, kudos to Microsoft then, on the style and flair with which they've been granted so many questionable patents.

Microsoft argued their claims pre-dated those of TypeRight Keyboard Corp. Then, in a twist of events, the US Court of Appeals for the Federal Circuit in Washington DC said there was "genuine issue" with the credibility of a Microsoft witness. Bottom line, the invalidity judgment was improperly granted. Next step, trial and lots of billable hours by lawyers." The article is pretty sketchy on details, but it certainly appears to imply that someone fudged the prior art proof.

A patent for which Microsoft applied on March 6, 1997, has been granted: "Discoverability and navigation of hyperlinks via tabs." In other words, when a computer user uses the Tab key to move the focus from one hyperlink to another on a webpage opened in a browser, the use of that function is now owned by Microsoft. The Tab patent, number 6,785,865, was granted on August 31st, just one among multiple patents granted to the software giant on that day. Another interesting grant is number 6,784,354, with an application date of March 13, 2003: "Generating a music snippet." Yes, you read that right. Now dividing a music stream into portions is Microsoft's domain.

In what's most likely to be the result of a screwup at the patent office, it appears that Microsoft has patented Apple. Well, not exactly. A new patent has been issued on a new type of apple, and for some unexplained reason, the patent has been assigned to Microsoft. The patent makes no mention of Microsoft, and the most likely explanation is that someone filled in the assignee field incorrectly. However, it makes for an amusing headline, sure to get plenty of attention.

The new version of their clipboard tool adds new action buttons, pop-up previews that allow you to view clippings, store file aliases, name clips. iClip runs in a floating window on the desktop and allows you to store and retrieve text, URLs, pictures, movies and more in multiple bins that can be arranged in groups. The new version is a free upgrade for registered users of any previous version. The full edition is US$19.95, and a demo is available for download from the Inventive Web site. Digging through some FCC filings, my cow-orker Fred von Lohmann turned up a bit of Disney magic that tips the company's hand: they're planning to lock up everything capable of recording audio.
Well, in their latest comments, Disney (which is an RIAA member, and owns ABC Radio Networks and four record labels) let slip what this is all about:

In addition, to the extent the Commission considers such a content protection mechanism, it should also consider whether to extend that mechanism to all music distribution platforms, including satellite digital audio radio service, the Internet and broadcast radio service.

Got that? Disney wants the FCC to regulate all devices capable of recording from any audio broadcasting medium or from the Internet. FM radio, XM, Sirius, Streamripper, Total Recorder, you're all in the crosshairs. It's the Hollings Bill all over again.

But they're not late to market, no. Instead, they took their time to "eliminate many of the annoying shortcomings that are present in earlier BT mice."

You know, I actually saw one of these The Mouses the other day in person (a corded one, not the Bluetooth model) and they really look a lot better in person than they do on their website. Something about their photos makes the acrylic shell look rough, but it really isn't when you actually see it.
