allofmp3.com, the Russian company that
sells tons of online music by the gigabyte, and he said it is not
likely that anyone who buys music from the site could get in trouble.
We sought some advice from a Melbourne barrister and
contributor to these pages, Simon Minahan, who practises in the area
of intellectual property.
His opinion: "There's probably nothing to stop the individual from
downloading this material for private use. For end users, the issue is
a basic question relevant to acquiring a reproduction of any copyright
work: has the rights owner consented?"
Even if allofmp3.com's asserted licence is bogus, says Minahan, "the
end user would seem to have a good basis to argue that he is an
innocent infringer, which would mean he isn't liable to damages,
although he would still be liable to an order requiring him to destroy
or deliver up any copies and an order requiring him to refrain from
doing it again."

Smaller than the death-dealing, missle-launching UAV
(Unmanned Aerial Vehice) drones is the MAV—the Micro Air
Vehicle. This particular model, called the Wasp, is currently being
tested with the Nimitz Carrier Strike Group and weighs just seven
ounces. It can be controlled from the ground (via a taut string and an
11-year-old) or can wirelessly follow a pre-plotted path using GPS
coordinates, snapping pictures from forward and aft cameras. It's not
unlike the ship-orbiting 'options' from Gradius, except they
can't deflect as much laser fire.

Trent Reznor from the Nine Inch Nails has released the full-tracked
GarageBand Format of their song, "The Hands That Feeds". This is a
first as far as we know. Here is the info direct from Trent and you
can download the song from MacMegaSite.
For quite some time I've
been interested in the idea of allowing you the ability to tinker
around with my tracks - to create remixes, experiment, embellish or
destroy what's there. I tried a few years ago to do this in shockwave
with very limited results.
After spending some quality time
sitting in hotel rooms on a press tour, it dawned on me that the
technology now exists and is already in the hands of some of you. I
got to work experimenting and came up with something I think you'll
enjoy.
What I'm giving you in this file is the actual multi-track
audio session for "the hand that feeds" in GarageBand format. This is
the entire thing bounced over from the actual Pro Tools session we
recorded it into. I imported and converted the tracks into AppleLoop
format so the size would be reasonable and the tempo flexible.
So...
You need a Macintosh and you need GarageBand 2.0. If you
have a newer Mac, you already have the software. The more RAM you have
the better. I did this on a PowerBook 1.67 w/ 2G RAM but it has been
running on far less powerful systems.
Drag the file over to your
hard disk and double click it. Hit the space bar. Listen.
Change
the tempo. Add new loops. Chop up the vocals. Turn me into a woman.
Replay the guitar. Anything you'd like.
I gave this to my crew
and band to test out and all work effectively stopped for a while -
it's fun to mess around with. I've now heard a country version of the
track as well as an abstract Latin interpretation (thanks, Leo).
There are some copyright issues involved, so read the notice that
pops up. Giving this away is an experiment. I'm interested to see what
comes of it, what issues are raised and what the results are.

processes, and no one ever said they needed to be run in the same
manner as a profitable business, but the fact that they
can't
even track the thousands of different databases and logistics
systems that are supposed to keep track of all of their purchases
and assets is a bit worrisome. At the very least it's a huge recipe
for fraud, with plenty of already greedy enough defense contractors
clearly abusing the system for great profit to themselves -- at the
expense of our own tax dollars.

Fading Ways Music,
an indie record label based out of Toronto, announced their 2004
releases will be sold under Creative Commons Attribution-N
oncommercial-ShareAlike licenses. Fading Ways Music is the first
internationally-distributed label to adopt Creative Commons licensing
for its new physical CD releases. Fading Ways articulates its
philosophy for open-licenses nicely on its mission page.
Neil Leyton, the label's manager, makes a great quote here: "Music
Publishing as a concept is wrong. No one creates songs out of thin
air."
Fading Ways joins other labels, such as Opsound, Magnatune, and Loca Records that embrace Creative
Commons licenses, enabling fans to rip, mix, and burn their favorite
tunes without legal doubt.

conference in Santa Monica today, Sony Pictures Digital
Entertainment SVP Michael Arrieta said:
"We want to set business models, pricing models, distribution models
like (Apple Computer CEO Steve) Jobs did for music, but for the film
industry," [said Arrieta], "I'm trying to create the new
'anti-Napster."
To that end, Arrieta said, his group plans to digitize Sony
Pictures' top 500 films and make them available for the first time in
various digital environments within the next year. He said the
distribution for films like "Spider-Man 2" will go beyond just
Movielink, the video-on-demand joint venture of Sony Pictures and
several other major studios, which to date has hosted a limited
library of Sony's movies.
For example, Sony plans to sell and make films available in flash
memory for mobile phones in the next year, Arrieta said. It also will
further develop its digital stores for downloading and owning films on
the PC, he said in an interview. Sony's plans--and similar moves by
other studios--are likely to avoid empowering any one technology
company--such as Apple in the music equation--and allow studios to
pocket more of the profits. The philosophy in Hollywood is "Define
your own agenda or someone else will for you."
