The latest in the Eolas patent saga is that someone at the Patent Office has finally agreed to review the patent based on stacks and stacks of prior art that people have been finding. Amazingly, the Patent Office appears to have responded quickly (though, they don't say how long it will take for a new decision on the patent) to the requests for a re-examination of the patent. There's a quote from the USPTO's deputy commissioner for patent examination policy saying that this was an "extraordinary situation" which necessitated the quick response. The problem with this statement is that it's not an extraordinary situation. In fact, it's an increasingly common situation, where silly patents are getting the stamp of approval every day - and then used to hold other companies up for extortion, rather than for encouraging innovation.

I think it's about time we came up with a new topic/icon for stupid patents. There are just so many of them these days. The latest is that Adobe, who is no stranger to abusing intellectual property rules, is now being hit with a patent over their PDF technology. The patent is for a method of extracting network information via hyperlinks. Reading through the patent, they're basically describing a system for clicking on a hyperlinking and having the system not only download the page in question, but all locally related pages linked from that page as well. Perhaps a useful system, but it seems like this sort of technology was around well before the patent was granted, and it's unclear what it has to do with PDF files.

Richard C. Jaworski announces that the US Patent Office has granted his “Petition to Make Special” on his System of Testing the Upstream Cable Modem Channel (TUCMC) patent application. The petition to the US Patent Office alleged infringement of his technology by Acterna Corporation in their DSAM 2500 Cable Modem Test Instrument. Mr. Jaworski has written evidence that Acterna knew of the patent and the technology prior to releasing the feature in the DSAM 2500. According to patent law, triple damages are applicable for prior knowledge infringement as soon as the patent issues. Due to its special status, Jaworski expects the patent to issue in the immediate future. [PRWEB Sep 27, 2004]

As most of us know, the EFF has been after certain IT related patents recently. You may not, however, be aware of which patents are under attack.Patents identified by the EFF for challenge include:— a method for administering tests over the Internet— a system and method for playing games on a network— a method and apparatus for implementing a computer network/Internet telephone system (VoIP)— an audio and video receiving and transmission system— a system for generating, distributing, storing, and performing musical work files“What makes these patents among the worst of the bunch (is) the fact that their owners are threatening and filing suits against small businesses, individuals, and nonprofits, not to mention the threats to free expression and innovation that each of them pose,” the EFF said on its Web site.

My cow-orker Jason Schultz made the NYT this weekend in a piece about EFF's fight to bust crappy Internet patents. My favorite bit of the article is this bit of deadpan juxtaposition:
Another patent on the foundation's list covers a way to make telephone calls over the Internet. Mr. Schultz said the company holding that patent, Acceris Communications of Toronto, had drawn the group's attention by filing an infringement lawsuit against a relatively small service provider, ITXC, rather than larger companies like Vonage Holdings. Small companies rarely have the resources to fight infringement suits, Mr. Schultz said.

The president of Acceris, Kelly D. Murumets, rejected the charge that the company was pursuing only small rivals.

"Acceris has not targeted smaller players," Ms. Murumets wrote in an e-mail message. "In point of fact, and only after offering a license, Acceris filed a lawsuit against a major player" in the industry, ITXC.

Some years ago, a collegue of mine asked me how I would stop music pirating.  I haven't thought about the problem before but it took me only a minute to decide P2P spoofing was the best intermediate answer.  It was obvious that traditional DRM wouldn't work and spoofing attacked the problem at reasonable cost, could be deployed fast, and adapt to changes in real time.  My collegue nodded and that was that.

According to Wired, someone had the exact same idea and filed a paten t in 2000.  Now I am scratching my head.  Is this a silly patent or not?  Should I be filing patents on similar ideas?  Heck, I can pump out enough ideas like that everyday to keep an army of patent lawyers busy if someone would just keep throwing problems at me and file my answers as patents.  I even have ideas on how to efficiently generate new patents.  Maybe I'll even best IBM at the game.

If you are an idle patent lawyer, come to me and I'll keep you busy.  How does 50-50 sound?  Filing cost?  No problem.  Let private investors place 'bets' on the patent applications they like out of daily streams of patent applications.  Together we'll worsen the patent problem ten-fold within a year and force the Congress to come up with a better solution.  Now that's a silver-spoon full of patriotism for ya.  :-)

MSNBC is running yet another article that looks at problems with the patent system, focusing on the problem we most discuss around here: small intellectual property houses that buy up perfectly obvious patents, or those with prior art, and then go around threatening small sites to get them to pay up rather than fight the ridiculous patent. In most cases, the patent is for taking some sort of obvious action and moving it onto the internet. Even a strong defender of patent rights admits in the article that the "pendulum may have swung too far." No one is saying their shouldn't be patents, but there are way too many cases where these sorts of patents are clearly being used to hold back innovation - which is against the very point of the patent system.
