With the announcement of its cash dispersal already made, some analysts have suggested that Microsoft's results will bring better news than expected. With the cash question settled, investors will be looking elsewhere on Microsoft's balance sheet for answers. After asking investors for months of patience, Microsoft on Tuesday announced a plan to return $75bn (£41bn) to shareholders over four years through a combination of increased dividends, stock buybacks and a one-time payout of $32bn. That had been a major concern of analysts who felt that a distribution of cash could boost Microsoft's share price, which has been flat for some time.

Chips are arbitrary; cores are not. In my review of Sun Java Desktop System release 2 I criticized Sun Microsystems for imposing such restrictive licensing terms on their customers. A discussion on Groklaw followed, and Sun contacted me to discuss the license and how it might modify it in the future. I had several suggestions, and overall they were happy to have the feedback and eager to make their future license agreements more user friendly. But proprietary thinking dies hard. Xten has announced its newest Session Initiation Protocol (SIP) SoftPhone, eyebeam, which, like other SoftPhone software previously released by the company, will turn your Mac into a phone that can place and receive calls via Voice-Over IP (VoIP), a protocol that carries voice data over the Internet. An OEM version of the company's X-PRO SIP SoftPhone was just made available to Vonage subscribers who use Mac OS X, as reported by MacCentral on Thursday. eyeBeam SoftPhone will offer H.263 and H.264 IP video conferencing, CDMA cellular network support and such telephony features as instant messaging and encryption. Xten is currently demonstrating the new product at Supercomm 2004 and will soon make a Beta release available to select partners, with the commercial roll-out slated for October. eyeBeam will be Mac OS X compatible, but the company hasn't released system requirements and pricing yet, nor had it placed a product page on its Web site as MacCentral posted this article.

When I started thinking about taking kottke.org full-time, one of the things I wanted to do was not work out of my apartment most of the time. But office/work space in NYC is expensive and I figured I wouldn't have room in the budget for it. There was also the matter of the proper environment. I just didn't want to exchange working alone in my apartment for working alone in an office. A smallish workplace with like-minded folks focused on similar projects was my goal.

So, I'm pleased to report that starting sometime later this month, I will be an Eyebeam R&D Senior Fellow for the next year or so. Eyebeam aims to be a center for art and technology and with recent projects like Fundrace, ForwardTrack, and ReBlog, there's quite a bit of overlap in what Eyebeam and I are interested in. They are not supporting me financially and I won't be officially working on any projects for them, but I will be working in their new R&D space in Chelsea. The hope is I'll not only have a physical place to work but that both parties will benefit from my presence in that space. That is, if some of their chocolate gets into my peanut butter (and vice versa), that would be a good thing.

So thanks to Eyebeam for their support of my personal digital exploration and am looking forward to working with the other researchers, artists, and fellows. Here's their post on the subject.

As reported by Mac FixIt, we have confirmed that QuickTime's MPEG-2 component (an additional purchase made by several users which allowed the playback of MPEG-2 files) expired on December 14th, 2003, leaving thousands of users without the ability to play MPEG-2 files. We have also confirmed that a re-install of the component has no effect.

Update: Repairing permissions has no effect.

Update: Several MacFixIt readers are reporting that the MPEG-2 component for QuickTime 6.3 is working properly. This problem may only be related to the new MPEG-2 component released for QuickTime 6.4.

Cory Doctorow: Tucows is starting a service to auction off expired domain names, but with an escape hatch to ensure that the former holders of the expired domains don't get scr0d.
Yet, Tucows plans to protect the previous registrant's existing rights because even if a URL enters the auction, the old registrant still has a window of opportunity to retain the name under the system. Noss said Tucows plans to "hold the name in escrow for another 30 days" on top of a period of "anywhere from one to 45 days" that a former registrant has to reclaim their domain name after expiry, depending on which registrar they're dealing with.

Martin Luther King's "I Have a Dream" speech is still in copyright (as is almost everything else familiar in our lives), and Dr King's heirs strictly enforce the copyright. Wendy Seltzer points out what this means for free expression and political commentary.
You can always quote a few lines without asking permission, but that's likely to be the same few lines that have become cliched with repetition. Quote the whole speech to make a more substantial point, and you face thousand-dollar license fee claims from the estate. Quote them to make a point critical of King, and you may be denied a license entirely.

So ordered the 6th Circuit Court of Appeals. Sampling, we're told, is piracy. But be certain to see the 19 footnotes in this relatively brief opinion, or the 28 separate quotes the opinion includes from other peoples work. I assume the court got a license for those. Now that's not quite fair. The court's decision turns upon its "literal" reading of the sound recording statute. The sound recording statute has no de minimus exceptions, the court held. So while you are free to copy three notes from a musical composition, you can't copy the same three notes from a recording. So copying (so long as de minimus) is fine; cut & paste is not. It is a "bright-line" rule the Court has crafted: Ask permission first. (And don't worry, they might have added. It's simple.) So once again: life in the analog world is freer than life in the digital world. You can do it, just don't use technology to do it -- unless, of course, your lawyer has spoken to their lawyer.
