Johnny Fox's Freakatorium

Johnny Fox's Freakatorium 06/05/2005 11:42 PM
David Pescovitz: Today's New York Times profiles swordswallower/prestidigitator Johnny Fox, proprietor of the recently-closed Freakatorium, a cabinet of curiosities in New York City's Lower East Side. From the New York Times (photo by Douglas Healey):
Images 2005 06 04 Nyregion 04Freak.Large2In January, Mr. Fox's rent went up and he had to close. Now he has moved his wonders to a farmhouse in Connecticut where the only thing they collect these days is dust.

His narwhal tusks stand in the attic near a loose pile of taxidermic heads. His elephant's-foot liquor chest sits in the living room, seen by no one but himself.

His two-headed turtle lives downstairs in the basement with a sleepy boa constrictor. Out in the garage - forgotten - are Tom Thumb's vest and Sammy Davis Jr.'s glass eye.

"I'd love for this stuff to be in New York," said Mr. Fox, a sinewy and black-haired man of 52. "New York needs this kind of stuff, but who supports it anymore?"

It is a hard question to answer. Mr. Fox discovered that his Freakatorium was not the tourist destination he had hoped it would be. Even with its relatively modest $5 admission fee, it drew only 5 to 15 visitors a day....

He has even thought of changing the roguish name of his establishment to cater to a different clientele.

"I figured we could call it the Chamber of Wonders, not the Freak-atorium," he said. "Freak sometimes has a stigma to it. We could do something family-inviting."

Even at its height, the Freakatorium was never meant to be a profit center. It was rather Mr. Fox's chance to earn a living while sharing his obsessions with the world.

Suing the Saudis

Suing the Saudis 09/11/2004 03:49 AM
Suing the Saudis The Port Authority of New York and New Jersey has decided to join a $7 billion lawsuit that was filed last week by bond brokerage firm Cantor Fitzgerald, which lost 658 of its employees--two thirds of the firm--in the 9/11 attack on the World Trade Center, which was three years ago today. It looks like they may be gearing up to use RICO: "[The lawsuit said] Saudi Arabia engaged in a pattern of racketeering as it participated directly or indirectly in al Qaida's work through its "alter-ego" charities and relief organisations, which it funded and controlled." Al Qaida is named as a co-defendant, and four Saudis are mentioned by name: the interior minister, the defense minister, the governor of Riyadh, and the British ambassador, all members of the Saudi royal family.

Spammer Suing SpamCop

Spammer Suing SpamCop 04/30/2004 04:13 PM
A year ago, a group of spammers anonymously teamed up with a lawyer to sue a bunch of anti-spam groups. After those anti-spam groups fought back, the spammers eventually dropped their case. However, now we've got a similar situation. Scott Richter, the well known spammer behind OptInRealBig, is now suing IronPort, the folks who bought SpamCop last year. He's asking for $1 million in damages, saying that SpamCop has damaged his reputation. Has he given any thought to the idea that sending spam may have damaged his reputation? Among the many charges filed against SpamCop, Richter included Negligent Interference with Prospective Economic Advantage, Unfair Competition and Interference with Contractual Relationship.

A few months after filing lawsuits against a bunch of spammers, Microsoft has kept up the pressure, filing another set of lawsuits against more spammers. At this point, they're just filing John Doe cases, and hoping to find out who they are at a later date.

Google Back To Suing Froogles

Google Back To Suing Froogles 04/18/2005 06:48 PM
It seems that Google's trademark lawyers are busy these days. Last year, they were sued by the creators of some children's toys/books called the Googles and that was quickly followed up by a dispute with the guy who ran a shopp ing search engine at Froogles.com, which Google obviously felt competed with their own Froogle.com. The big problem, though, was that Froogles had been around longer than Froogle (whoops!) leading to an arbitration panel letting the guy keep his domain. Google tried to defend their position by noting that Froogles was confusingly similar to Google (not Froogle). This way, they could make the claim that Google had been around longer than Froogles. However, what the arbitration panel doesn't give, perhaps the courts will. An unofficial Google blog is noting that Google has reopened the case -- probably after the guy refused to settle and was holding out for a bigger offer. Once again, though, Google is focusing on the earlier claim that Froogles infringes on Google -- and they go so far as to state that any use of "OOGLE" in relation to search may be considered infringement -- which might be a pretty credible claim. It seems unlikely a company would use "oogle" without there being some confusion with Google.

Suing carriers over locked handsets

Suing carriers over locked handsets 06/09/2004 02:51 AM
A consumer-rights group is bringing suit against US mobile carriers for locking their handsets:
In the lawsuit, the foundation said that because the companies all use the same wireless network standard, called GSM, customers should be able to use the same phone across those carriers' networks just by changing out an easily-replaced unit called a "SIM card" inside the phone.
The carriers may claim that locked handset let them offer cheaper service -- because they keep you from using your subsidized handset with another carrier, but I don't buy it. I got a free T-Mobile handset by promising on pain of an enormous cancellation fee to stick with them for a year. In the meantime, why shouldn't I be able to rent a SIM when I go to Toronto and put it in my phone? Why shouldn't I be able to loan my handset to a friend from out of town so that she can put her SIM in it and log on to her service? Link (via Hack the Planet)

Suing The Music Industry For Copy
Protection

Suing The Music Industry For Copy
Protection
01/05/2004 04:55 AM
A Belgian consumer watchdog group, Test-Achats, is now suing some of the big record labels for installing copy protection on their CDs. The article is a little unclear on what legal basis they seem to be suing - but it sounds like it's one of two things (or possibly both): (1) the CDs are not clearly labeled and don't play on certain equipment, meaning that they're defective or (2) by adding copy protection, the CD takes away the rights of users to make personal copies. While I do think copy protection is a costly and pointless tool used by the recording industry, I'm not sure there's much of a case here (other than - perhaps - on the labeling issue). I don't think there's any legal reason why the industry should be prevented from putting copy protection on their CDs. I just think it's a bad business decision that will add to the cost while making the product worse for consumers. However, if the industry wants to shoot itself in the foot, that's completely up to them. Update: In related news, a consortium of big name players in the tech world are trying to come up with a new copy protection scheme that they say will work. It's designed to allow for limited copying and sharing, while also taking into account the fact that most people want their content to be portable. Of course, like every other content protection scheme it will be broken very quickly - and thus, will only inconvenience legitimate users.
