Richter, the founder of spamming service OptInRealBig, are currently
in the middle of a fairly nasty
legal
battle over whether or not SpamCop can block OptIn's spam. Still,
the two have
agreed to appear together in public and debate the topic.
Both of their lawyers say that the debate will avoid the issue of the
lawsuit, but as the article points out, that seems unlikely. The
thing is, in listening to what both sides have said over the years,
you already know what they're going to say in this debate - and
they're talking at cross purposes. The spammers focus on their right
to make money, while everyone else talks about their right to be left
alone. The problem with the spammers' position is that they
don't have the right to make money. They have the right to
try to make money, but if it involves pissing everyone off, and
everyone decides to create and use filters to make email bearable
again - then that's their right too.

more interested in the way(s) spammers collect their victim's
addresses. In fact, I routinely receive junk mail in various languages
I don't even understand (Chinese, German, Korean, Brazilian, and God
knows what else), let alone having any relationship whatsoever with
those countries. So I started thinking how the heck some email
addresses of mine ended up in those spamming lists.

It’s an interesting read. One of the main characters is a
moron who shows his ignorance at every turn. There are many claims
that what they are doing is Search Engine Optimization (SEO). There
are legitimate SEO companies, and there are guys like these. If you
are hiring a SEO company, make sure you know what techniques they are
using or you might end up with a site marketed in the same manner as
the porn and prescription drug schemes they are discussing.

un-secured hotspots and sending spam from the open connections: The
original story here is one of those infuriating reads that doesn't
mention how the guy got caught. It seems that historically people who
have gotten caught for improperly using hotspots have done so by being
stupid or unlucky. It's otherwise difficult to track someone down
especially if they move around a lot looking for insecure hotspots....

hacking: Being a crazy sports fan is one thing. Spoofing the
email address of area sportwriters and spamming everyone, apparently,
is not.
But yesterday, Carlson sat alone in a federal courtroom in
Philadelphia, the accused boo-bird who hijacked the e-mail addresses
of area sportswriters and sent out tens of thousands of anti-Phillies
cyber-rants in their names.
"Like a lot of people, he was not happy about the fact that the
Phillies were not winning," Assistant U.S. Attorney Michael L. Levy
said in his opening statement to the jury. "But Mr. Carlson... decided
to do something more. He launched an electronic attack against the
Philadelphia Phillies and Philadelphia Newspapers Inc."
They're charging him with identify theft under federal law. He
sent 100,000 emails, one of which resulted in 60,000 bounces to a
local sports columnist.

fined this
week for sending out a ton of SMS text spam to mobile phones. The
company apparently went through classified ads in newspapers to
collect phone numbers, which they then spammed. While the company in
question initially apologized for the spamming and said it was an
"honest mistake," it's beginning to sound like that apology wasn't so
sincere. The company is now hitting back that the anti-spam law
is unfair to smaller companies, because it takes
away this particular way to annoy people -- while larger companies can
still use telemarketers to annoy users in a different (but similar)
way. Of course, all this really suggests is that Australia needs to
do a better job stopping unwanted telemarketing also. The spammers
have clearly missed the point. It doesn't matter whether others are
allowed to do similarly annoying practices. It's that such
unsolicited interruptions are a real nuisance to people no matter who
they're from or what format they happen to arrive in.

Verizon Wireless of sending text message spam has received
a permanent injunction against sending SMS text message
spam to mobile phones. However, the more important part is
whether or not it matters. The guy in question seems to have
disappeared. It's barely mentioned in the article, but he didn't show
up at the hearing at all, and the article suggests his last known
address is not valid. Basically, it sounds like the guy skipped town,
or at the very least, didn't care enough to show up for a case against
him. It seems unlikely he's going to let a random judge tell him to
stop sending SMS spam.

While we keep hearing scary, scary stories about how open WiFi access
points would allow spammers and virus writers to send out their evil
payloads with
no
chance of getting caught, it looks like reality has struck again.
Back in June we noted that an open WiFi extortionist was
caught
using typical detective methods (and a good helping of stupid
criminal behavior), and now Security Focus has the story of a
plea deal
for a WiFi spammer in California, who drove around Venice,
California with a WiFi-enabled laptop sending out porn spam via open
WiFi connections. What the article
doesn't say is how the guy
got caught. After all these stories about how it would be absolutely
impossible to catch WiFi spammers, it seems we have pretty good proof
that's not true. It's just that investigators have to use other,
traditional detective means to track them down.
