Prelude To A Fake Complaint 06/24/2004 06:22 PM
Senator Orrin Hatch and his colleagues on the Senate Judiciary Committee have introduced the Inducing Infringements of Copyright Act this week. They want us to think the Act is no big deal, and that it targets only the bad guys while leaving the good guys alone. They say that it doesn't change the law; it just clarifies it. But they're wrong. And this legal complaint ins the proof. By Electronic Frontier Foundation (via MyAppleMenu)

Ray Bradbury's Bizarre Complaint

Ray Bradbury's Bizarre Complaint 06/20/2004 12:12 AM

Ray Bradbury is one of the great science fiction writers. But in his advancing years he's also acting in a fairly petty manner. The author of the brilliant novel "Fahrenheit 451" is claiming to anyone who'll listen (AP) that Michael Moore has somehow committed an act of intellectual theft by naming his new movie "Fahrenheit 9/11" without asking permission. He may have a shadow of a point here, but not much more than that. Here's why. First, you can't copyright a title. See "What is Not Protected by Copyright" on the website of the U.S. Patent & Trademark Office. If Bradbury or anyone connected to him is even thinking of suing, forget it. (There's no trademark on the expression "Fahrenheit 9/11", by the way.) Second, Moore didn't use the same title. He did a word-play on Bradbury's book -- a clever gimmick that resonated with anyone who'd read the novel, a stark warning against totalitarianism and call for people to think for themselves. This kind of thing goes on all the time, and it's part of the artistic process -- building on what came before by using cultural references (of which Fahrenheit 451 is deservedly one) in new creative works. Third, as several people have noted, Bradbury -- author of "Something Wicked This Way Comes" (William Shakespeare) and "I Sing the Body Electric" (Walt Whitman)-- wasn't what you'd call fastidious when it came to totally original titles (not that he should have been). Apparently Bradbury is mostly bothered by Moore's title for commercial reasons, because of an upcoming movie based on his book. (Francois Truffaut did a weird adaptation in the 1960s.) I heard him on a local talk-radio station today, and after he dumped on Moore he seemed cheerful enough in talking about the picture. He's certainly getting plenty of publicity mileage, anyway. The host of the far-right-wing radio show was abysmally uninformed, meanwhile. She was asking him if he planned to sue Moore. Bradbury wisely indicated no such plans, because he'd likely be laughed out of court. (The host also read approvingly from the Foreword to an early edition of the book. It was by a teacher at a Quaker school. She plainly missed the irony.) Moore would have been smart to send a letter to Bradbury months ago, saying the name of his new film was an homage to one of the essential pro-freedom and pro-thinking literary works of recent times. Bradbury would be smart to let this go.

Will Mini iPods Delete Bigger iPods?

Will Mini iPods Delete Bigger iPods? 01/07/2004 06:38 PM
Well, as every other tech site in the world is now telling you, the not-so-secret rumors that Apple was coming out with a "mini iPod", cleverly named "iPod mini" are completely true. The other big story people are focusing on are that Apple has gotten past their Henry Ford-style color options, and will offer the iPod mini in multiple colors. You can read all the details at other sites, but in looking over the stories about the device, I'm wondering if the iPod mini will replace the iPod itself as the popular music device of choice. Personally, I don't own an iPod or any portable digital music player (I barely have any digital music - so buying such a device would only mean I need to rip all my CDs, which is a project I'm still not ready to bother with). Still, the iPod mini seems to make a lot more sense to me than many other portable music devices. The early MP3 players had way too little memory, but once you get up into the 4 gigabyte range, I wonder how much more some people need. Historically, of course, that's a dangerous viewpoint to take - since we've always figured out ways to fill up empty storage space. With Apple even advertising games, calendars and other iPod apps - you can imagine that the memory will go. However, if I were in the market for such a device, I'd definitely go with the mini iPod version right now: it's a better size for carrying around and it's "good enough" in terms of storage space - not to mention that it's cheaper. Thus, while I'm sure there are some people who simply need to have more storage space, I'm wondering if this mini iPod will steal marketshare away from its big brother.

HOWTO bl0g anonymously

HOWTO bl0g anonymously 04/08/2005 12:54 AM
Cory Doctorow: EFF has released a guide to blogging anonymously, with "basic measures people can take to keep their blogs anonymous and explores what the law says about discussing work-related issues online. Some advice is common sense; for example, don't post a picture of yourself if you want to stay anonymous. But for bloggers who want strong guarantees of privacy, EFF suggests using technologies like Tor or Anonymizer to prevent your blog-hosting company from logging your computer's unique Internet Protocol (IP) address. Bloggers who fear they could be fired for blogging are also given an introduction to laws that prevent an employer from punishing them for speaking out online."
The bad news is that in many cases, there is no legal means of redress if you've been fired for blogging. While your right to free speech is protected by the First Amendment, this protection does not shield you from the consequences of what you say. The First Amendment protects speech from being censored by the government; it does not regulate what private parties (such as most employers) do. In states with "at will" employment laws like California, employers can fire you at any time, for any reason. And no state has laws that specifically protect bloggers from discrimination, on the job or otherwise.

One way to make sure your blog doesn't earn you a pink slip is to make sure that you write about certain protected topics. Most states have laws designed to prevent employers from firing people who talk openly about their politics outside of work, for example. Be warned that laws like this do vary widely from state to state, and many are untested when it comes to blogging.

HOWTO set up a VSAT in Iraq

HOWTO set up a VSAT in Iraq 04/19/2005 03:38 AM
Xeni Jardin: Jake in Iraq wrote a detailed post about setting up VSAT internet connectivity near Sulimaniya. One of the purposes this connection will serve: getting a voting office online. Jake's a pretty serious geek. He says he's been asked not to share exactly why he's there, or what exactly he's doing for whom, but this is sure an interesting post.
This is how I spent my day today. It took around 6 hours round trip to drive to Sulimaniya, Iraq. This in Kurdistan where we did the install. I learned some stuff, it's mostly simple labor but it raised some interesting questions in my mind about interception.

As far as I can tell, it's entirely possible to intercept any data being sent to earth in an entirely passive way. I'm going to look into this more before I make any outlandish claims, if you know, feel free to let me know.

Update: Jesse Andrews, the fellow who wrote this de-Xeni script, would appear to be busted. :-) Chad Hurley, who identifies himself as Mr. Andrews' employer, says:

Hi Xeni,

Just a note about Mr. Andrews and his "de-Xeni" plugin - We’ve caught him looking at far worse things than your "over the top" posts. Why he has picked you to filter, one may never know, but I have an idea for a plugin. Maybe I will add it to the Grease Monkey requests. It’s really simple. When Jesse opens Firefox, it directs Jesse to a folder on my server called, "Things Jesse needs to do today before the big hand is on 12 and the little hand is on 5"! Just an idea.

Keep on keepin' on,

Chad

HOWTO stop procrastinating

HOWTO stop procrastinating 09/09/2004 08:59 AM
Cory Doctorow: On Merlin Mann's 43 Folders productivity blog, he runs through a great high-level overview of the geek-cult-smash, "Getting Things Done," a comprehensive and nerdy guide to systematizing yourself out of procrastination.
Stuff is bouncing around in our heads and causing untold stress and anxiety. Evaluation meetings, bar mitzvahs, empty rolls of toilet paper, broken lawn mowers, college applications, your big gut, tooth decay, dirty underwear and imminent jury duty all compete for prime attention in our poor, addled brains. Stuff has no “home” and, consequently, no place to go, so it just keeps rattling around.

Worst off, we’re too neurotic to stop thinking about it, and we certainly don’t have time to actually do everything in one day. Jeez Louise, what the hell am I, Superman?

So you sprint from fire to fire, praying you haven’t forgotten anything, sapped of anything like creativity or even the basic human flexibility to adapt your own schedule to the needs of your friends, your family or yourself. Your “stuff” has taken over your brain like a virus now, dragging down every process it touches and rendering you spent and virtually useless. Sound familiar?

HOWTO turn a t-shirt into panties

HOWTO turn a t-shirt into panties 01/06/2005 04:49 AM
Cory Doctorow: If you've experienced the heartbreak of wearing out a beloved t-shirt, despair no longer. Here is a recipe for turning an old t-shirt into a pair of knickers.
Find a clean (if you care) shirt that strikes your fancy. I have used shirts with printed pictures or words, anything I thought would look good on my butt. You might not want to use your prized material possession if it's your first time. Figure out if you have enough material for underwear (see item 1 above), and cut out the two main pattern pieces. You can cut the crotch piece out of the same material, or you can use a new fresh T-shirt or whatever. (I keep a few Hanes white undershirts on hand.)

HOWTO: Find Mt. Everest from Space

HOWTO: Find Mt. Everest from Space 01/22/2004 02:03 PM
Mt. Everest, the tallest and most famous mountain of our planet, exhales a fascination which goes up all the way to the ISS.  That's easy to believe after taking a peek at this spectacular shot. However, that doesn't mean finding Everest in an easy task. To quote NASA: Space is a good place to ponder the world's extremes and nature's variability. For example, photographing the highest point on the planet is a favorite target (and a long-standing challenge) for astronauts orbiting the Earth. Despite Everest's planetary stature, it is not an easy peak to locate while zipping over the mountains at 7 kilometers per second. Luckily for us, the nice folks at JPL have made a step-by-step tutorial on finding Mt. Everest from space. Now, where do I sign up for those tickets?
