on offshoring this week, and have concluded with two that are worth
reading. The first isn't really a part of the series, but goes well
with it, explaining (again!) why
protectionist
plans don't work. This has been explained over and over again,
and there are countless examples of how protectionist policies cause
many more problems than they solve, but apparently, it needs to be
reviewed once more. The second piece is much more interesting. The
question that anti-offshoring people always bring up is "what other
jobs are there?" They're afraid that all jobs will be offshored and
then there will be nothing left (except, the example they love,
flipping burgers). Of course, history has shown that's not what
happens at all. The US was an agricultural economy for a long time,
and we shifted and it certainly made life very difficult for a lot of
people - but we innovated and created new jobs and a higher standard
of living. We've done so again and again and again. So News.com is
looking at
what
might be next. The problem, of course, is that it's difficult to
predict what really is next. So often disruptive advancements seem to
come from unexpected places. Researchers working on one thing
serendipitously discover a completely different breakthrough that
leads to an entire new industry. Of course, to put that all together
though, we need to support better education and push for more research
and development (which often isn't helped when companies only think in
the short term thanks to Wall Street). However, to prepare for
"what's next" we need to create a culture that involves constant
learning and education focused on useful areas of expertise - and not
so much on specific tactical expertise. Understanding how to make a
horse and buggy isn't useful - but understanding the basic concepts
concerning transportation is still useful no matter what mode of
transportation is used. Having that base of knowledge, with constant
additional training, let's someone work on buggies, automobiles,
trains, planes and whatever else comes next.

04/28/2004 02:31 PMOne of my complaints concerning most interviews with Jack Valenti
concerning his views on copy protection is that most interviewers
don't ask any of the tougher questions that Valenti should answer.
Now,
Slashdot is pointing to
an
interview of Valenti by an MIT student, where the student
confronts Valenti about why he can't watch legally purchased or rented
DVDs on a Linux machines, and actually shows Valenti some "illegal"
DVD descrambling code, which apparently gets a curse out of Valenti.
While it is amusing to see Valenti get flustered, it doesn't seem like
the most productive interview. Rather than focus in on such a tiny
aspect (why you can't watch DVDs on a Linux machine) it would have
been more interesting to get at some of the bigger questions
concerning the MPAA's views on intellectual property - such as how
things like the VCR (which Valenti called "the Boston Strangler of the
movie industry") actually saved the industry.

appearance was marred by his press secretary moving the camera and
attempting to end the interview early when Russert, the interviewer,
started to ask a hardball question about the fictional Nigerian
yellow-cake uranium that Powell used as an excuse to go to war in
Iraq.
Most noteworthy about this event was that Powell, rebuked the
press-secretary on air, demanded that the camera be trained on him
again, and then answered the question, describing the intelligence
he'd received as "deliberately misleading."

I'm a late addition to a panel at the Supernova conference this
Thursday, June 24: I'll be joining some very interesting people (Technorati's David Sifry;
blogger, XML leader and now Sun engineer Tim Bray; and Paul Boutin of Wired and
Slate). We're talking about syndication and RSS. The question the
panel faces: "Is there more to syndication than reading 300 blogs at
once?" What interesting, useful applications for RSS and RSS-like
tools are out there or just around the corner?
I've got my own answer(s), but in the decentralized spirit of the
conference, I'll open the floor here in comments, and present anything
you folks suggest, too.

1. How will the evolution of new kinds of micro-content, like
Reviews, Events and music playlists - effect the existing
blogosphere? A: it will enhance it, making it not
onyl richer and deeper, but also make it more relevant to average
people - who don't want or feel the need to blog, but who have
opinions on movies, books and reataurants.
2. How will FOAF interconnect entire social networks, on-line
communities and blogging tool userbases together? A:
by enabling digital IDs that encompass multiple presences, end-users
will be able to move freely from system to system without having to
recreate their strong ties every time.
3. Finally - Salon was one of the first content sites to offer
it's readership Blogs. Now that the AlwaysOn Network is also offering

the Neilsen-rating results come out there’s a loser, and the loser
always grumbles about how the methodology is busted and they’re
really not doing that bad. Similarly, whenever Amnesty International points the
finger at some government, that government makes like a losing TV
network and whines that the process is broken. Recently, Amnesty had
some pretty
harsh things to say about the collateral human-rights damage from
the US “War on Terror”. Dick Cheney snarle
d predictably and the right-wing blogosphere is pushing back
mightily: “AMNESTY INTERNATIONAL seems to have flushed its
credibility...” and there are pages of outrage based, not on the
substance of what Amnesty said, but on their temerity in comparing
Gitmo to a gulag; thus, thousands of words explaining that the gulags
were much, much worse; indeed they were and that was dopey of Amnesty.
But it’s just so totally like how Central American dictators used to
say “But the Communists are worse” and Communist governments used
to say “But the Apartheid racists are worse” and Apartheid racists
used to say “But the black-ruled dictatorships are worse.” I’m
not an American, so this is just a hint from a friendly neighbor:
being better than the gulags isn’t good enough. When your Neilsen
ratings are bad, you need to run better shows, and when Amnesty gets
on your case, you need to stop brutalizing
people.

The RIAA has finally seen the light with regard to its "Clean Slate"
program, which offered false amnesty, or shamnesty, to people who
admitted to file sharing. Citing the success of its "education"
campaign, the group has abruptly cancelled the program.
"Clean Slate" promised that in exchange for a confession, you could
gain meaningful protection from lawsuits for copyright infringement.
In fact, the program left you vulnerable to lawsuits by record
companies and music publishers, as well as bands like Metallica that
retain independent control of music rights.
Eric Parke, represented by Ira Rothken, brought suit, charging
fraudulent business practices -- and here, perhaps, we can glean the
true reason for the RIAA's change of heart. Its attorneys announced
during a recent court proceeding that the group had discontinued
"Clean Slate" -- and that therefore the case was moot. The
announcement took Mr. Parke, his attorney and the judge by surprise.

unauthorized music files, they offered their
amnesty
program, which basically said if you 'fessed up to sharing music
and removed those files immediately, they probably wouldn't sue you.
Of course, they couldn't guarantee that the actual copyright holders
wouldn't sue - and in admitting guilt to the RIAA some felt that
people would actually open themselves up to
more liability for
exactly that reason. In fact, even a US Senator, Norm Coleman, told
people
not to
fall for the program and some people
filed a
lawsuit against the program, saying that it was deceptive. Well,
now the RIAA (as they've been known to do) has asked that the lawsuit
be dismissed
because they've recently canceled the amnesty program.
Of course, that makes you wonder. Is it okay to offer a "deceptive"
program for a few months, and then ask that lawsuits against it are
dropped once you stop? Doesn't that just encourage more temporary
deceptive programs? The article also notes, by the way, that over
1,100 people actually signed up to request such not-really-amnesty.
The RIAA promises that they'll continue to not sue those individuals,
though, they still can't make the same promise for the actual
copyright holders.
