to roll back time to the 19th century. Re-activists are the judges who
have reactivated federalism by rediscovering the "dignity" of states.
Re-activists view Lawrence v. Texas - last year's gay sodomy case - as
having all the jurisprudential force of a Post-it note. When the
United States Court of Appeals for the 11th Circuit upheld an Alabama
ban on the sale of sex toys last month, it did so by sidestepping the
logic animating Justice Anthony Kennedy's opinion in Lawrence.
Ignoring Kennedy's lofty promises of sexual privacy - his assurance
that "there is a realm of personal liberty which the government may
not enter" - the 11th Circuit framed the case as a dust-up over the
constitutional right to a vibrator.

According to an AdAge.com article, CBS may reject MoveOn.org's bid to
have the winner of the "Bush in 30 seconds" ad competition run during
the Superbowl. A spokesman for CBS said the Viacom-owned network
has received the request from MoveOn to run the ad in the Super Bowl,
but added that the ad has to go through standards and practices before
CBS will say if it can run an advocacy ad during the game. The
spokesman said he didn't think it was likely that the spot would pass
standards and practices. (You can view the ad in question here.)
Exactly what these "standards and practices" are is unclear, but of
the advertisers listed, at least three are running political issue
ads: American Legacy Foundation: "Likely to be a new excecution in
the 'Connect-truth' (anti-smoking) campaign." Philip Morris USA: "A
new execution in its corporate responsibility, anti-smoking campaign."
White House Office of National Drug Control Policy: "The drug office
is in the big game for the third year in a row."

02/11/2004 03:58 AMNearly two years ago, I was surprised to find a legal decision I
agreed with (they happen so rarely) where a judge had
tosse
d out author Harlan Ellison's lawsuit against AOL, saying that
AOL, as a service provider, was not responsible for Usenet postings
that contained Ellison's stories. Note, these stories weren't even on
AOL - but on Usenet, available from just about every ISP out there.
Ellison, though, has decided that it's not worth understanding the
technology when you can just sue and because he could see the posts on
AOL, it must be AOL's fault. Thus, he has
contin
ued fighting the case, to the point where he's spent almost all of
his money on the lawsuit. He insists that this is all AOL's fault
because it took them two weeks to respond to his request to block the
Usenet posts in question. Unfortunately, it appears that my relief at
a smart judicial ruling was premature. An appeals court has
overturned the ruling and sent it back to the court,
saying that AOL loses their DMCA liability protection because of the
amount of time it took them to respond. In other words, DMCA
protection against liability (one of the very few good things in the
law) is limited by your response times to complaints. Ellison,
continuing to miss the point, is declaring victory, but AOL is still
confident they'll win the case anyway.
