Sony Music Chief Explains Why Supreme
Court Should Cover His Lack Of
Imagination
03/28/2005 06:00 AM
Earlier this month, Sony Music chief Andrew Lack gave an interview where he ranted and blame d kids downloading music for his own inability to adjust the company to the changing marketplace. It appears that he's not stopping. In an interview with USA Today, where the interviewer deserves credit for asking the tough questions, Lack again shows his lack of creativity and inability to manage -- and determines that he needs the US Supreme Court to pick up the pieces from his own failures. The interviewer asks Lack: "Instead of attacking a technology, isn't it your challenge to find ways to use it constructively?" Lack responds by saying: "I've tried. The P2P services ... aren't willing to discuss in good faith a legitimate usage of their material." In other words, because Lack can't figure out how to leverage these technologies to his advantage there simply isn't a way? Meanwhile, plenty of others have found that embracing the technology can help them make a lot more money than they were before. So, the court case comes down to the fact that Lack (and his colleagues) lack creativity and business acumen in helping their firms adjust to new technologies. There's no reason why the Supreme Court should be protecting bad executives just because they have no creativity. Also, Lack claims that all he's seeking for in this case is "balance." There's no "balance." The makers of buggies didn't get "balance" when automobiles came along -- and they didn't get to have the Supreme Court cripple automobiles to make the buggies remain competitive either. That is what this case is about. The entertainment industry wants to cripple the internet to make it more like radio or TV. That's "balance" to them.

Don't like what the annual report on International Terrorist activity says? Just kill it--forever (never mind that the law requires it) -- The State Department decided to stop publishing an annual report on international terrorism after the government's top terrorism center concluded that there were more terrorist attacks in 2004 than in any year since 1985, the first year the publication covered. ... other current and former officials charged that Secretary of State Condoleezza Rice's office ordered "Patt erns of Global Terrorism" eliminated several weeks ago because the 2004 statistics raised disturbing questions about the Bush's administration's frequent claims of progress in the war against terrorism. "Instead of dealing with the facts and dealing with them in an intelligent fashion, they try to hide their facts from the American public," ...

Winning car chases with microwaves 02/05/2005 09:26 PM
David Pescovitz: Eureka Aerospace in Pasadena is developing a High Power Electromagnetic System that can fry a vehicle's microchips and slow cars to a halt. According to a Wired News report, the 5 foot by 4 foot antenna array could be mounted on police pursuit vehicles or helicopters. It's slated to be ready for testing by the Los Angeles County Sheriff's Department by late summer.
"The beautiful part of using the (microwave) energy is that it leaves the suspect in control of the car," (LA Sheriff's Department Commander Sid Heal) said. "He can steer, he can brake, he just can't accelerate."

Another benefit to such a technology, Heal said, is that it would give officers the ability to pinpoint where they want to stop a car -- on a freeway overpass, for instance -- which would limit a suspect's opportunities for escape.

"It's going to change law enforcement tactics," he said.

In a disgraceful decision, the U.S. Court of Appeals for the District of Columbia Circuit has held that the detainees at the American base at Guantánamo Bay have no right to any due process or any relief from the judicial system. The ruling is based on the legal fiction that Guantánamo Bay is sovereign Cuban territory -- if that were actually true, the United States would have been expelled by the Cubans a long time ago. I predict that this set of rulings will come to be be seen as the Dred Scott rulings of the 21st century. The prisoners, most of whom have been in pens for over a year, remain officially "disappeared." They are not Prisoners of War, even though some of them were fighting with the government of Afghanistan, because that would confer too many rights on them. And they are not charged with criminal acts, because we don't have evidence that would stand up in a court of law. As the NYT said in an editorial today, they held incommunicado, in legal limbo, indefinitely. Everybody is entitled to have their claims heard by an impartial party. As the NYT suggests, it doesn't have to be the same rules and formality as the U.S civilian court system, but there have to be some rules, some process, and an impartial judge. Otherwise, it is tyranny. Power corrupts. This is not the American way. This is totally at odds with our traditions. If we let America act this way, the terrorists have won. They have turned us, into them.
