AP - A new study has found that "yo-yo dieting" — repeatedly losing, then regaining weight — may harm a woman's immune system. The study by the Fred Hutchinson Cancer Research Center also found that maintaining the same weight over time appears to have a positive effect on a woman's immune system, according to one of the lead researchers.

The latest in the Eolas patent saga is that someone at the Patent Office has finally agreed to review the patent based on stacks and stacks of prior art that people have been finding. Amazingly, the Patent Office appears to have responded quickly (though, they don't say how long it will take for a new decision on the patent) to the requests for a re-examination of the patent. There's a quote from the USPTO's deputy commissioner for patent examination policy saying that this was an "extraordinary situation" which necessitated the quick response. The problem with this statement is that it's not an extraordinary situation. In fact, it's an increasingly common situation, where silly patents are getting the stamp of approval every day - and then used to hold other companies up for extortion, rather than for encouraging innovation.

I think it's about time we came up with a new topic/icon for stupid patents. There are just so many of them these days. The latest is that Adobe, who is no stranger to abusing intellectual property rules, is now being hit with a patent over their PDF technology. The patent is for a method of extracting network information via hyperlinks. Reading through the patent, they're basically describing a system for clicking on a hyperlinking and having the system not only download the page in question, but all locally related pages linked from that page as well. Perhaps a useful system, but it seems like this sort of technology was around well before the patent was granted, and it's unclear what it has to do with PDF files.

Really not quite sure what to make of this one, but it's too amusing to pass up. Apparently, a few years ago, ESPN posted a picture of famed daredevil Evel Knievel with his arms around two women (one of whom was his wife) with the caption: "You're never too old to be a pimp." Knievel, not realizing this was a (weak) attempt at complimenting him, sued ESPN for defamation. A lower court tossed out the ruling, and he appealed. Now the Appeals Court has ruled against him as well, noting that, based on the context no one is actually going to think Knievel is a "pimp," and, in fact that the statement was supposed to be a positive one, as the slang of the day suggests. Knievel, apparently lacking a sense of irony over this particular case, has responded by calling the judges "bimbos." The full quote is: "They ruled against the law. What good is law in the United States of America if five or six goddamn bimbos are going to rule against it?" You think he intended that as a compliment? Anyway, in the meantime, feel free to go on captioning photos on the web while calling people pimps.

Richard C. Jaworski announces that the US Patent Office has granted his “Petition to Make Special” on his System of Testing the Upstream Cable Modem Channel (TUCMC) patent application. The petition to the US Patent Office alleged infringement of his technology by Acterna Corporation in their DSAM 2500 Cable Modem Test Instrument. Mr. Jaworski has written evidence that Acterna knew of the patent and the technology prior to releasing the feature in the DSAM 2500. According to patent law, triple damages are applicable for prior knowledge infringement as soon as the patent issues. USA Today is claiming that the rules have changed for resumes, now that they're mostly sent via email instead of snail mail. However, when they get into the details, they sound amazingly like the "rules" many of us learned back in the days before you emailed resumes: focus on results from previous jobs (read: throw in lots of useless percentages to make it look like you improved something), use "descriptive or significant terms" (read: make sure you include the BS buzzwords-of-the-moment to make it through that first pass filter), don't send the wrong cover letter to the wrong company (read: don't be completely stupid), and don't apply "above your skill level" (read: don't waste HR's time so much). I remember hearing all of these years ago as well, and they don't seem any different in this "new age of electronic resumes" as the article would have you believe. Then, of course, there's the biggest recommendation for this supposed new age: they suggest you spam as many companies as possible. Again, has there ever been a time when people were told to send out fewer resumes? If anything, it seems like this strategy is the wrong strategy in the digital age where HR folks are so inundated with resumes that some have found that going back to paper resumes is much more effective in getting attention.

You know, you learn interesting things from people if you peek at their music collection. And iTunes music sharing over the LAN is one of those things that boggles your mind.

I was in a hotel the other day, connected to the local network. I started iTunes and found like six people sharing their music over Rendezvous. So I got to peek inside the heads of complete strangers, sitting somewhere in the building, happily doing their own stuff, while I see and find interesting new music completely effortlessly. It's like listening to everybody else's personal radio stations, except that you get to mix and match and shuffle to your heart's content.

While this article is focused on things in the UK, the idea equally applies here in the US where the FCC has suddenly gone on high alert trying to "clean up" the airwaves. The idea is that if broadcast companies started sending additional content to TiVo or TiVo-like PVR devices that could fit around the show, but never actually be broadcast on television, there's no reason that that the additional content needs to abide by regulations. So, in the article linked here, it talks about advertisements for beer and cars that don't need to meet specific (very strict) advertising laws in the UK. In the US, you could (in theory) include additional "too hot for broadcast TV" content that could easily be slotted in to programs viewed on a PVR. Of course, as with any kind of loophole, it's only a matter of time before lawmakers with too much time on their hands decide to close it.

The New America Foundation, Media Access Project, and some vendors say that the FCC hasn't gone far enough by adding more spectrum to the unlicensed band around 5 GHz: They complain that because the spectrum is high on the band and because of the power constraints set by the FCC, rural WISPs still can't adequately serve customers. They are asking for more unlicensed spectrum in the lower bands where signals can better penetrate interference like trees and travel farther. Rural operators and vendors who try to serve them have long discussed the fact that while the existing power limitations may be useful in cities they unduly strap the potential of wireless in rural communities. Dave Hughes, who has done tons of research on the use of wireless in remote areas, has often suggested that the FCC might set different rules in rural areas. That's a good idea. But I fear that the needs of the rural communities may not mean enough to the FCC to encourage the commission to consider accommodating them....
