My
cattle grazing grounds are not my idea and vice versa. But thanks
to laws I can "own" the idea as if the idea was a cow ; link
goes to a interesting university-level paper [PDF].
The author makes some interesting analysis and points attention to the
fact that current intellectual property laws can go against well
established economic theories at the expense of free market
competition theory, technical innovations and society-as-a-whole best
interest.
Recommended to people with economic theory experience , but also to
everyday public-goods-privatization opposers as the paper isn't
(intentionally) way too technical.

announcing the creation of an
Intellectual Property Task Force is an amazing example of the
extremist
rhetoric that has come to dominate discussion of digital content
protection. Yes, those who create digital goods are entitled to
compensation, and violating intellectual property rights, like
speeding, is against the law. But the way this issue is being
cast as a challenge to our way of life is just excessive and
counter-productive.
My favorite is the statement that "Intellectual
property industries play a significant role in the American
economy." What exactly is an "intellectual property industry?"
More to the point, what isn't? I doubt Wal-Mart would be very
successful if others could copy its name in misleading ways, or could
reprint its newspaper ads with higher prices.
Of course, that's not what the press release is talking about.
The term is intended to redefine industries built around creative acts
(like the music business) as industries based on exclusive
formalizations of past creativity. Larry Lessig
and others have said this better than I can, but the point remains
important. Countless small rhetorical shifts have brought us to
a
point where the discourse around intellectual property is wildly
foreign to our professed values. Are our heros the pioneers who
charted new territory... or the land speculators who came later?

innovat
ion was more important to the economy than invention, while noting
that the patent system was really more focused on protecting
invention, and slowing down innovation. Now, Robert I. Sutton is
noting the worrying trend that, as startups are showing up again, they
all seem to be most focused on
protecting and hiding their
intellectual property which
tends
to harm, more than help, innovation. Remember, the original point
of the patent system wasn't just to protect information, but to open
it up so that others could make use of it. Unfortunately, that use of
the patent system is becoming less apparent every day. Sutton points
out, properly, that some protection of intellectual property makes
sense, but: "If you take it too far, innovation can't happen. If you
never show your ideas to other people, or to only a very few
like-minded people, then your ideas won't get any better and you won't
get the information you need about which customers will—and will
not—buy them." Innovation happens by getting your product out into
the market and figuring out what it takes to get people to buy into
the idea." Innovation isn't about a (patentable) spark of genius, but
"world-class persistence to spend long hours trying to do new things
with old ideas." Isn't it time we reformed the patent system to
encourage real innovation, and not this focus on hiding away
inventions and making innovation more difficult?
