struggling to find the right balance between making--and delivering
on--promises made to customers during their Software Assurance
contract periods.
In the past six months, Microsoft, Redmond, Wash., has found itself in
the awkward position of acknowledging that the long-promised WinFS
next-generation file system would have to be cut from the Longhorn
upgrade of Windows to guarantee its on-time delivery in 2006.
More recently, Microsoft executives confessed that two key features,
Network Access Protection and integrated Digital Rights Management
Services, which were supposed to appear in its interim R2 Windows
Server 2003 update, will not make it into the 2005 server update after
all.

HPod/
iPod announcement, there were a few other interesting stories.
I've been hearing from folks at CES that Carly Fiorina's keynote was a
doozy, in that it lined up supporters from the music industry who
spent all their time bashing kids downloading music. Reports are now
coming out talking about
HP's
anti-consumer rights stance on these things. Once again, all of
these features
do not make things better for consumers - they
just make things worse. At the same time, it will do nothing to slow
down real piracy - as those folks will just get around the copy
protection. So, what we're left with is an offering that is less
friendly to consumers, more costly to HP (and, therefore, consumers),
and does nothing to help anyone. The other "word from the floor" we
heard at CES is that HP employees in the same room as the keynote even
agreed that this policy was bad news, and were upset that their
employer had decided to go with such an anti-consumer stance.
Meanwhile, Tristan Lewis writes in to point out that the bigger news,
buried in HP's announcements today is
a
bout their Lightscribe offering, which will let DVD and CD burners
silkscreen images directly onto the CD. While I'm not sure I agree
with Tristan's assessment that this is a bigger story than the iPod
deal, it is a cool idea.
Update: As pointed out in the
comments, Tristan's description goes a bit further than the actual
product: it doesn't actually do silkscreening, but creates "silkscreen
quality labels".

is unlikely to demonstrate that level of growth again. With no fewer
than nine price-driving stock splits since going public in 1987,
Microsoft has been a substantial wealth generator. On October 21,
2002, shortly after Microsoft reported its blow-out quarter (resulting
almost entirely from a switch to a licensing model for its software
sales) I wrote on thestreet.com's Real Money Pro site that Microsoft
would begin to encounter hurdles that would delay, and perhaps even
curtail, long-term outperformance; And that those earlier high-growth
days appear to be history for Microsoft. The PC explosion during the
1980s and 1990s was a one-off growth opportunity in this sector. While
similar growth opportunities may materialize for Microsoft in other
areas of tech in the years ahead, I'm not holding my breath.
Previously, to make money in MSFT stock you just had to buy and hold,
unless you bought at around a split-adjusted $120 between end-1999 and
end-2000. The price has since steadily eroded to the $23-$30 range
where it continues to trade.

hooking me up with the appropriate XSLT. Now that
I have a simple XML format that can be edited with Infopath, and XSLT
to render to the formats I want, maintaining the list is vastly

Windows with serial numbers associated with bootleg or fake copies.
It's an interesting dilemma for MSFT: the more unpatched copies of
Windows (whether legit or not) the worm infects, the worse it becomes
for
all unpatched users, including those who paid their
license fees. It's like denying smallpox vaccinations to known crooks,
then having to pay the social cost of the smallpox outbreak that
infects everyone who hasn't had a shot (including honest cits).

and three-dimensional Black Rock City for Microsoft Flight Simulator
2002 and 2004 platforms.
[I]n the spirit of Burning Man's no-commerce, gift economy philosophy,
he's making his project available for free. One of Burning Man's
mottos is "participants only," and, fittingly, Johnstone's Virtual
Playa rewards active involvement. On his site, he provides free 3D
building tools that Burners can use to model a version of their own
camp or art project, which they can then upload and incorporate into
the complete Virtual Playa version available to everyone. If people
want to design a camp made from pre-fab pieces, he provides digital
tents, domes, RVs, U-Haul trucks and many of the other details.
"You can be your own Larry Harvey if you want. You can put whatever
you want in," says Johnstone. "They can scratch their playa itch in
March when they're not feeling very Burning Man."

acquired a company called Intertrust solely for its patent on DRM,
which conflicted with the patent that Microsoft got when it took a
controlling interest in another company called ContentGuard.
Microsoft is paying $440m to settle its long-running digital rights
management (DRM) patent infringement dispute with Intertrust. The
one-off pay-out means that Microsoft customers can use their software
"as they are intended to be used without requiring a license from
InterTrust".

08/05/2004 03:50 AMIt appears that Yahoo heard the backlash loud and clear a few months
back when they released an anti-spyware tool that
just so
happened to skip over adware from Yahoo partners. The latest
version, built on PestPatrol's technology will now
default to
notifying users of both "spyware" and what they consider to be
"adware" and then give the user the choice of what to do. I
haven't tested the product yet, but it sounds like they're moving in
the right direction. It still makes you wonder what they were
thinking in offering a purposely crippled offering. People know what
spyware is, and telling them that spyware isn't spyware doesn't change
how people feel about it. It also doesn't make them look kindly back
at the company that provided them with the bogus anti-spyware tool in
the first place.

the situation is even more complex because Claria (who you probably
know as Gator - despite their attempt to
change
their name to shake that spyware label) is also a partner of
Yahoo. So, it's really not surprising that
the default
setting for Yahoo's anti-spyware app won't actually remove services
like Gator or WhenU. Instead, Yahoo's spyware remover claims
these programs are "adware" and will only remove them if you click and
extra check box
each time you run the program. In other words,
once again, you can't trust a provider of anti-spyware software,
because they're playing both sides of the fence: partnering with
providers on the one hand, and then offering weak removal products on
the other. If Yahoo were serious about removing spyware from the
computers of users they would refuse to partner with companies that
used surreptitious tactics to be installed on computers. Instead,
they want to look good to users in the front, while letting in
spyware/adware from partners through the backdoor.
