Someone who prefers to remain anonymous, sent in a link to Marshall Brain's attempt to track how much time he spent dealing with computer problems in the month of December. There's nothing out of the ordinary in there. As the anonymous submitter states: "He had 21 documented problems. He's got everything we all normally experience -- driver problems, software problems, crashed apps, etc. He simply tracked it all for one month and came up with a total of over 11 hours in wasted time!" Sounds about right, unfortunately. Speaking of which, I just spent a good twenty minutes troubleshooting a finicky wireless router.

Over in the UK, where they passed their own weak anti-spam law last year (saying it was okay to spam businesses) it turns out things are worse than they seem - as the law is only window dressing for a year or more. The authorities charged with enforcing the law are saying they don't have the necessary resources to actually enforce the law, and probably won't get around to do anything until next year. So, spammers in the UK have just been given notice to... keep on spamming.

The FTC is happily announcing the fact that a federal court has shut down one of the big-time Florida pill spammers, Creaghan A. Harry. He's listed in Spamhaus' register of known spammers (though, as Harry Creaghan - which Spamhaus says is his r eal name even if he insists on reversing it). A federal judged has barred him from sending any more spam, and frozen his assets (which just so happen to be in Latvia). Of course, it remains to be seen if this actually does anything to slow down spam. Still, it's a start.

Julian Haight, the founder of anti-spam service SpamCop, and Scott Richter, the founder of spamming service OptInRealBig, are currently in the middle of a fairly nasty legal battle over whether or not SpamCop can block OptIn's spam. Still, the two have agreed to appear together in public and debate the topic. Both of their lawyers say that the debate will avoid the issue of the lawsuit, but as the article points out, that seems unlikely. The thing is, in listening to what both sides have said over the years, you already know what they're going to say in this debate - and they're talking at cross purposes. The spammers focus on their right to make money, while everyone else talks about their right to be left alone. The problem with the spammers' position is that they don't have the right to make money. They have the right to try to make money, but if it involves pissing everyone off, and everyone decides to create and use filters to make email bearable again - then that's their right too.

A new federal obscenity sentence has been issued against a Montana man who operated a catalog business called "Suzie's Corral." Gary Robinson was said to have sold bestiality and scat videos, distributing them via UPS. AFAIK it's the first such obscenity prosecution in Montana, period. The Billings Gazette has more:
The videotapes, which had titles like "Dogs and Horses and Pigs and Chickens," contained graphic scenes of bestiality and other sexual activity that involved excretory functions, Mercer said. Transportation by common carrier of obscene material in interstate commerce is a crime, Mercer said, and is not protected by the First Amendment guarantee of free speech.

The U.S. Supreme Court ruled in 1973 that to be obscene, material must appeal to the "prurient interests," be "patently offensive" and lack serious literary, artistic, political or scientific value. The court said obscene material should be judged by local standards. Ultimately, the local standards would be decided by a jury.

Jeremiah writes "Amidst the public ballyhoo about how rampant P2P piracy is costing the music business its very life (gasp! NO!), BMI announced it collected a record level of revenue and royalty payout to its artist members. From their press release: "BMI has reported revenues of $673 million for the 2004 fiscal year, an increase of nearly $43 million, 6.8% over the prior year. Royalties of more than $573 million were distributed to our songwriters, composers and music publishers, an increase of $40 million or 7.5% from the previous year, and the most ever paid by an American PRO." Another interesting tidbit: "During the period 1995-2004, BMI had an average annual revenue growth rate of 9%..." If I read this right, BMI has been reporting solid growth over the last nine years, which makes me question the industry's claims about P2P. Either P2P ate into their growth (not mentioned), they found a way to cope with it (plausible), or it may actually help music sales. Whatever. Reminds me a bit of a spec I did for a life-insurance company's radio ad: Money , Money, Money (mp3 file)."

Here's one for all of you pessimists out there. It turns out that pessimists tend to make more money gambling or investing in the stock market (is there a difference?). This isn't really that surprising, because the real story is that everyone loses money - it's just that the pessimists tend to limit their losses, while the optimists believe that they're about to turn things around. Still, it seems that some optimists quoted in the article (as is their nature) aren't ready to throw in the towel, while even the pessimists seem less than thrilled about their lot in life as winners at the gambling table. In the end, it seems that no one wins, except the skeptics who are neither optimists nor pessimists, but don't believe a damn thing.
