dismissed a lawsuit filed by
AOL against some spammers because the judge claims not to have
jurisdiction over the spammers. The spammers are in Florida, but AOL
(and the court) are in Virginia. Once again, the question of
jurisdiction online becomes important. Should the spammers be liable
in Virginia because their emails hit AOL's machines (based in
Virginia) or should it be filed in a Florida court?

filed a
lawsuit against Ken Adelman for photographing her home as part of
his effort to photograph the entire west coast of the US for
environmental purposes? Despite the fact that it was one of many
thousands of photos, shows very little detail and was taken from
public airspace, Streisand claimed it violated her privacy. Well, now
a judge has looked at the suit, scoffed, and
tossed it out, saying that the lawsuit actually
infringed on Adelman's right to free speech. Once again, this is an
example of trying to hide something online - and in the process
drawing
a lot more attention to it. If Streisand hadn't spoken up, very
few people would even know the photo existed. Now, millions do - and
it's all completely legal.

12/19/2004 03:10 PMeWeek is reporting on what is thought to be the
largest federal judgment against spammers in history. CIS Internet
Services has been awarded damages to the sum of $1bn. Judge Wolle
ruled that CIS were being harmed by the sending of un-solicited emails
by these companies. He ruled that they had broken the law under the
Federal Racketeer Influenced and Corrupt Organizations Act and the
Iowa Ongoing Criminal Conduct Act.
Kramer, owner of CIS, described the resolution as "a victory for
all of us that open up our e-mail and find lewd and malicious and
fraudulent e-mail in our boxes every day''. The judgement was based on
a cost of $10 per spam message; it’s thought unlikely that Kramer will
ever be able to get the $1bn from the spam companies. The resolution
hands down large fines against the three main offenders, none of which
responded to contact, or were present at a bench trial in November of
this year.
Kramer's 9 year old company provides email services for users in
Clinton. According to court documents, he noticed a rise in spam on
his network in 2000, and at one point saw as many as 10 million spam
messages a day. CIS Internet Services user’s were especially
vulnerable as many of their email addresses were listed on a widely
available spam CD – “Bulk Mailing 4 Dummies” – which gives simple
advice to would be spammers on how to get started. It is hoped that
the judgement will send a strong message to companies who persist in
sending users unwanted messages.

EFF's helped win another victory this week! We filed a brief in RIAA
vs Charter, a case where the music industry was asserting the legal
right to require your ISP to turn over your information if you'd been
accused of copyright infringement -- rather than waiting until they'd
proven their case. The court ruled in Charter's favor yesterday,
saying that just because you've been accused of infringement, it
doesn't mean that you shouldn't have the due process right to privacy
until you've been proven guilty.
The Electronic Frontier Foundation (EFF), along with 21 other groups,
including the American Civil Liberties Union (ACLU), the Consumer
Federation of America (CFA), and the Computer & Communications
Industry Association (CCIA), filed a "friend of the court" brief in
the Charter case, urging the Eighth Circuit to determine that the same
strong protections applied to anonymous speech in other contexts also
apply when copyright infringement is claimed but has not yet been
proven. In a victory for privacy and anonymity, the Eighth Circuit
determined that DMCA subpoenas could not be used to get this
information.
