Richard C. Jaworski announces that the US Patent Office has granted his “Petition to Make Special” on his System of Testing the Upstream Cable Modem Channel (TUCMC) patent application. The petition to the US Patent Office alleged infringement of his technology by Acterna Corporation in their DSAM 2500 Cable Modem Test Instrument. Mr. Jaworski has written evidence that Acterna knew of the patent and the technology prior to releasing the feature in the DSAM 2500. According to patent law, triple damages are applicable for prior knowledge infringement as soon as the patent issues. Despite a three-year head start, satellite TV providers will lose their DVR edge over cable companies by 2006, according to Internet-Based Video Services, a new white paper from research firm Parks Associates.Although satellite companies began offering DVRs as early as 1999, they will not be able to overcome the advantages cable companies have in offering a complete bundle of fully integrated services. Altnet , a peer-to-peer technology company, filed suit against nine companies for infringement infringement for their information-gathering application. The claim is that the named firms, such as Big Champagne , used Altnet's software and concepts for obtaining information about user activities within peer-to-peer (p2p) networks:

"Our intent has always been to commercialize peer to peer, and if anyone is misusing our patent for any reason, I have to protect that intellectual property," [Altnet Executive Vice President] Broes said. "If they're building business on the backs of the patent I worked hard to acquire, then they should talk to us."

Given the large audiences using p2p applications for (among other things) file-sharing, many intellectual property owners have used or considered using them to learn more about market behavior and preferences.

TV content aggregation is not a business for network operators, who will do better to form partnerships with satellite and cable operators to sell TV over broadband. Gross margins on TV can be as low as 20% but operators need TV services to compete with triple-play competitors. Fixed broadband (BB) operators providing TV reduce the net present value (NPV) of their business model over the first five years, according to Analysys calculations for this report. It looks like patent hoarding company Acacia is getting a bit cocky these days. Last year, the company made a lot of news for getting a questionable patent on "streaming media" and then suing porn sites, since they knew people wouldn't pay as much attention to them. Many sites felt the need to pay up, and Acacia used that war chest to go after bigger companies like Disney. Along the way, they got all excited because a judge upheld their patent rights - but only because no one showed up to contest them. These wins seem to have made Acacia cocky, and they've now decided that any company offering video on demand over cable or satellite services are also violating their patents. Thus, they've sued Comcast, Cox, Charter, DirecTV and EchoStar for violating the patents. These are companies that have a lot of money, and hopefully at least a few of them will stand up to this blatant patent extortion. People have been talking about video-on-demand service for ages. It's not a new concept, and it's unclear (again) how this helps innovation in anyway. Right now, it only looks like it's going to make video-on-demand services more expensive. In fact, Acacia will even tell you how much more expensive: they want $1.25 for every digital cable subscriber with video-on-demand, $1 for every digital cable TV subscriber and $0.50 for every analog cable TV subscriber. If they win, expect to see these charges added to your next bill. Apparently, higher bills count as innovation these days.

Several high-profile technology companies and movie studios are expected to announce Wednesday that they have formed a coalition to ensure that high-definition video and other content cannot be pirated in home networks.

Sources familiar with the group's formation said the initial members include IBM, Intel, Sony, Microsoft, Warner Bros., Disney and Panasonic. The announcement is scheduled to be made at the cross-industry Content Protection Technology Working Group (CPTWG) meeting in Los Angeles, although last-minute membership changes could occur before then.

The alliance marks the culmination of years of tentative and often suspicious contact between the high-tech industry and Hollywood. It will be aimed at developing specifications to protect copyrighted content such as movies inside home networks. If the group is successful, a consumer might be able to download a high-definition movie, store it on a PC, watch it on a television and transfer it to a mobile device to watch while traveling.
