time actually seeing other people, it turns out that the number one
activity online appears to involve figuring out a way for someone to
get out of their home to go somewhere else. According to the latest
study from the folks at the Pew Internet and American Life Project,
the
number one activity
online is finding maps (this is based on the percentage of people
who use the internet for this activity, and not how often this is
being done, of course). Coming in at second is communicating with
others. In other words, it appears that there are people out there
who only use the internet for finding maps, but who never actually
send out any email or do any other form of internet-based
communication. The study also notes that many of the online map users
have now learned that it no longer makes sense to ask for directions
offline.

01/05/2005 05:51 AMThere are some strange things happening with trademark law, and it
certainly seems to go beyond the scope of what it's intended to cover.
The point of trademark law is to prevent someone from passing off
their goods as someone else's. It's to avoid confusion. A trademark
shouldn't be considered something that you have absolute control over
-- but just in situations where confusion can occur. However, that's
not at all how it's being used. Instead, it's being used to stifle
any kind of comment that someone doesn't like. About a year ago, we
wrote about the somewhat bizarre case where the Greater Toronto
Airport Authority told a silly site that posts photos of urinals
(pretty much just for the hell of it) that
they
couldn't mention the name of the airport for no clear reason other
than that the GTAA didn't like it. The owners of that site,
Urinal.net, have now been approached again by someone who is trying to
stop them from posting perfectly legitimate information. In this
case, complaint is coming from the Marco Beach Ocean Resort, who is
claiming that it's somehow illegal to use their name on the website.
Urinal.net has responded by (amusingly)
distortin
g the name enough to try to get around the request of the lawyers
who contacted them. Part of the complaint seems to concern the fact
that the anonymous contributor mentioned that the urinal is viewable
from the lobby. Of course, courts have ruled that simply
passing
on content sent to you via the web or by email does not make the
person or company passing on the info liable for its content. So, if
the resort believes that this information is false, then it's not the
fault of Urinal.net, but the person who sent it in to them. I asked
the maintainers of the site if I could see a copy of the cease &
desist, but apparently the lawyers claim that the cease & desist is
copyrighted to them and that the recipient is
not allowed to
forward it to anyone. I wonder if that means they can't even
forward it to a lawyer? So, as far as I can tell, the Marco Beach
Ocean Resort seems to think that (a) they absolutely own all rights to
the name beyond what the law intends (b) they can blame the most
easily accessible party, rather than those who are actually
responsible and (c) any cease and desist is to be some sort of
"secret" cease & desist that can never be shown to anyone, which seems
to go a bit beyond what rights copyright gives them. How long is it
going to take before lawyers realize that the simple act of trying to
repress something they don't like online is likely to make it so that
something that most people would
never, ever see (like a photo
of a urinal in some random beach resort) is now seen by many more
people? Let's call it the
Streisa
nd Effect.

send online? Well, apparently
it's now the law. That's right --
sending any commercial audio or video files without attaching your
name and email address could lead to big fines and jailtime. The fact
that this goes completely against child privacy laws saying kids
should never be forced to give out private info apparently wasn't a
concern. It's not clear if the final version of the law made
exceptions for fair use (the original version didn't) or content that
has been designated for free sharing by its creators. It's also not
clear exactly
how you "attach" your real name and email
address. Basically, all this law really does is give California an
excuse to arrest anyone who does any file sharing -- because it's
clear that just about everyone is going to violate this law pretty
quickly.

the internet to read news - however, many claim that it hasn't
subtracted from their use of other sources of news. Of course, the
most popular "news" to check online is the weather - which some may
not really consider news. Still, many people do check their national
news online, though they tend to stick to traditional sources (such as
their ISP's home page or their local newspaper's website). Again,
this shouldn't be that surprising. There is a reason the mainstream
is called the mainstream. What will be more interesting, however, is
how these numbers continue to change over time, and whether or not
readers become more comfortable with non-traditional sources (or if
their own traditional sources start including more information
from other non-traditional sources) and how that changes our
perception of the news.

company that wanted to provide secure transaction software) saying
that
people
were going to shop less online due to fear of fraud and scams like
phishing (which have nothing to do with shopping online). This week,
thanks to some research paid for by PayPal/eBay we have a study saying
exactly the opposite. It turns out, according to this study, that the
increase in stories about these scams means that shoppers are much
more sophisticated and careful about buying online, but
they're planning to buy more and many feel the
internet is much safer for shopping these days. In other words, you
can't trust either study as both are impossibly biased by the money
that paid for them.

that I would window shop in a store, but eventually
buy
online. Well, if that's as evil as people made it out to be, it
appears I'm in some good company. A new study says that
nearly 70% of people now admit to doing
some offline browsing, before purchasing online. The thing is, to
me, it's no different than comparison shopping offline. If I'm
looking to buy something, I may visit a few stores offline before
finding a reasonable deal. Sometimes, a store will immediately offer
a good enough deal, or a level of convenience or additional value that
it's worth buying right away -- and sometimes not. Sites online are
just one more place to comparison shop. At the same time, the reverse
is true as well in some cases. There are plenty of times I've
researched products online before buying locally at a store. Either
way, it's clear that most people now have no qualms looking for the
deal that makes the most sense for them, whether it's on or offline --
and both sides need to learn to deal with that.

folks at the Pew Internet and American Life project says that

are saying they're downloading music. Beyond the obvious problem
that this study only counts what people
say they're doing, I
don't think it's surprising at all. Of course people are going to be
more cautious when there's a chance they're going to get sued.
However, I don't see how this is a good thing. All they've done is
annoy a bunch of people who should be their best customers. That
doesn't seem like very smart business.
