problems with the patent
system, focusing on the problem we most discuss around here: small
intellectual property houses that buy up perfectly obvious patents, or
those with prior art, and then go around threatening small sites to
get them to pay up rather than fight the ridiculous patent. In most
cases, the patent is for taking some sort of obvious action and moving
it onto the internet. Even a strong defender of patent rights admits
in the article that the "pendulum may have swung too far." No one is
saying their shouldn't be patents, but there are way too many cases
where these sorts of patents are clearly being used to hold back
innovation - which is against the very point of the patent system.

It might not be suitable for burning a can of franks and
beans over an dangerously oversized open flame, but the Sternform mess
kit is clearly a more modern solution than the wing nut-handled
aluminum pots and pans of traditional Boy Scout issue. Sort of a
thermal detonator for soup, the Sternform bowls have rubber tops and
vacuum hollows, keeping the contents warm. Built-in magnet rims cause
them to clip together, holding themselves secure in your pack or on
the included strap.
Painfully, the Sternform bowls are just a concept design, so be
prepared for dissapointment.

the big Comair systems meltdown over the holdays, CNN
has an article about why airline's systems are so rickety. It's
notable for a quote from uber-security expert Bruce Schneier that
tells the naked truth of it.
Bruce Schneier, a computer security expert in Mountain View,
California, said the issue boils down to cost versus benefit.
Airlines could upgrade existing computers to handle more
transactions, install sophisticated backup systems that come on when
the primary system fails or buy high-performance software that is used
by NASA, nuclear plants and medical facilities to keep critical
systems running at all times, Schneier said.
"It's certainly feasible, but it's my guess it's not economic,"
Schneier said. "My guess is it is cheaper for the airline to absorb
this loss, which doesn't happen often, than to fix the problem.
Isn't that the truth? Absorb the damage, move on, and wait for it
to happen again. Nice. Who gets to miss Christmas next year?

popping up in every other story. The latest one details some of the
pendi
ng patent fights likely to happen in the tremendously overhyped social
software world. There's been a lot of inbreeding within the
social software world with a number of the early players all investing
in each other. Reid Hoffman and Marc Pincus, for example, were both
early investors in Friendster - and then went on to create their own
social networking services that targeted different markets. However,
now that the venture capitalists have swooped in, the fear of a patent
battle is increasing. Jonathan Abrams of Friendster raised some
eyebrows a few months back when reporters asked him about business
models and he started ranting on and on about the patents they planned
to get. So now, Hoffman and Pincus have teamed up (without Abrams) to
buy the old patent that SixDegrees had many years ago. They're
basically hoping to use it as a defensive tactic against any patents
Friendster gets. I'm still wondering just what's so innovative about
any of these services that deserves a patent, but that's a different
debate. The article has plenty of details about what's happening, but
all I could think while reading this was that this focus on patents,
rather than actual innovation, business models or customers suggests
some of these services are already on the downswing. The "space"
itself hasn't even figured out a revenue model and new sites are
showing up every day - and the focus is on who gets the patents? It
has all the makings of a nice little infighting battle where all these
companies drag each other down.

the state of California will formally approve the merger of two health
insurance giants. An Indiana company called
Anthem will acquire
WellPoint Health Networks, the
Southern California outfit that owns Blue Cross of California, for
about $16.4 billion.
The deal has drawn harsh criticism for many reasons. Not least is the
display of raw greed by the insider executives who stand to collect
somewhere between $200 million and $600 million in payouts after the
