Details regarding the pending settlement of a class action lawsuit filed against Apple on behalf of G3 owners who have upgraded to Mac OS X are now available online. MacCentral first broke the news of the lawsuit in early 2002. The Los Angeles, Calif.-based law firm of King & Ferlauto, LLP. The suit claimed that Apple had violated the California Consumer Legal Remedies Act by failing to support certain G3-equipped Mac models with the same features in Mac OS X available to later systems, after saying in a 1998 press release that Mac OS X would be "fully optimized" for G3 systems.

The complaint was that Nextel's collecting of fees under the name of "Federal Programs Cost Recovery" was misleading because it implied that the fees had been mandated by the Federal government. Admittedly, wireless carriers are notorious for their poor service. However, with the advent of number portability, one would hope that a little competition should help to solve many of those problems. However, why wait for the market when you can sue? It looks like some groups are trying to come up with just about any excuse to file a class action lawsuit against mobile phone service providers. Now, I'm no fan of most of the wireless carriers - who I think have done a terrible job providing service to their customers and who are often misleading and downright sneaky in what they do. However, I also don't think bogus class action lawsuits help the situation much either.

Microsoft Corp. has settled antitrust class action lawsuits with five states and the District of Columbia, the company announced Tuesday. The six new settlements, with a total value of about US$200 million, brings the total number of states that have settled to 10. Class action lawsuits against Microsoft for antitrust-related practices continue in five states. The total cost to Microsoft of all 10 class-action lawsuits it has settled is about $1.55 billion, including a $1.1 billion settlement of a California lawsuit in January.

A federal appeals court has reinstated five lawsuits claiming that the cell phone industry has failed to protect consumers from unsafe levels of radiation. The class-action lawsuits seek punitive damages and want cell phone manufacturers to provide headsets, which they say could reduce risks of brain tumors, according to the Associated Press. The lawsuits originally were filed in separate state courts but were consolidated and transferred to federal court. The claims require the courts to explore the adequacy of the Federal Communications Commission's radiation emission standards, one ruling judge declared.
