The USPTO awarded a patent to Microsoft Tuesday for Writing Windows Applications Using HTML, which covers the authoring and execution of HTML that runs in its own window outside of the browser. Ironically, Microsoft occupies two seats on the W3C HTML Patent Advisory Group that's fighting the Eolas patent." Certainly seems like something that is pretty damn obvious, and not quite patentable. There must be prior art examples of people writing HTML applications outside the browser window? If this patent stands, though, it certainly sounds like Google's new desktop toolbar is in violation.

The stories of stupid patents seem to be showing up every day, and this article points out that if you're writing your own software or setting up a website, it's likely that you violate a ton of patents already. The article has the story of someone who wanted to set up an online video store, only to realize that just about every part of the store violated some patent. The cost of "licensing" all of those patents made the business impossible. Note that all he was trying to do was build the fairly obvious idea of an online video store. He wasn't "taking" any intellectual property - but because of the way the patent system is designed, his site never got anywhere. We're certainly beating a dead horse, but it's apparently not dead enough - because there's no real talk of changing the patent system. If the entire point of the patent system is supposed to be about promoting innovation - and it's clearly not doing that, why isn't anyone talking about changing the patent system?

Back in January I mentioned Agitar Software in a column on software testing. The backstory was that Agitar got in touch with me after reading my review of Compuwar e's DevPartner Studio. I had used NLucene, the .NET port of the Java-based Lucene search engine, as a benchmark to explore that product's debugging and source-code analysis features. Cory Doctorow: A GPL'ed automated computer science paper generator programmed by MIT students produces results so good that the output has been accepted at conferences.
Here are two papers we submitted to WMSCI 2005:

This paper was recently accepted as a "non-reviewed" paper!

God, between the pompous CS-speak ("few hackers worldwide would disagree with the essential unification of voice-over-IP and public/private key pair. In order to solve this riddle, we confirm that SMPs can be made stochastic, cacheable, and interposable") and the amazing diagrams, this thing is nearly the funniest thing EVAR. A security vulnerability exists in Microsoft Word that could allow malicious code execution. This vulnerability exists due to to the way Word checks the length of a data value (Macro names) embedded in a document. If a specially crafted document were to be opened it could overflow a data value in Word and allow arbitrary code to be executed. If successfully exploited, an attacker could then take the same actions as the user had permissions to carry out, such as adding, changing or deleting data or files, communicating with a web site or formatting the hard drive.

It's unfortunate that companies still feel the need to equate patents to "innovation" when the opposite is often true. These days, unfortunately, many companies feel the need to get patents simply as a defensive measure. Whether for defense or offense, it appears that Bill Gates believes Microsoft needs more patents. The company is ramping up their efforts to file for more patents and plan to extort license them to other businesses. So far, they're off to a good start. Some recently noted Microsoft patents include savin g the name of a game you're playing, showing that someone is "typing a message" in IM software, threa d based email, writing an application in HTML, groupin g programs together in the taskbar, pronoun s used in programming and the concept of giving "kudos" points for style and flair. Well, kudos to Microsoft then, on the style and flair with which they've been granted so many questionable patents.

A patent for which Microsoft applied on March 6, 1997, has been granted: "Discoverability and navigation of hyperlinks via tabs." In other words, when a computer user uses the Tab key to move the focus from one hyperlink to another on a webpage opened in a browser, the use of that function is now owned by Microsoft. The Tab patent, number 6,785,865, was granted on August 31st, just one among multiple patents granted to the software giant on that day. Another interesting grant is number 6,784,354, with an application date of March 13, 2003: "Generating a music snippet." Yes, you read that right. Now dividing a music stream into portions is Microsoft's domain.

In what's most likely to be the result of a screwup at the patent office, it appears that Microsoft has patented Apple. Well, not exactly. A new patent has been issued on a new type of apple, and for some unexplained reason, the patent has been assigned to Microsoft. The patent makes no mention of Microsoft, and the most likely explanation is that someone filled in the assignee field incorrectly. However, it makes for an amusing headline, sure to get plenty of attention.

In response to my post about a Microsoft presentation at Emerging Tech, Bob "Professor" Morris points us to a Microsoft page that explains something important about its XML schema for Word, Excel, etc.: Microsoft may have patents and/or patent applications that are necessary for you to license in order to make, sell, or distribute software programs that read or write files that comply with the Microsoft specifications for the Office Schemas. So, Microsoft's patents prevent me from writing a program that reads a Word XML file? Wow, that's harsh. And besides, isn't "schema" already a plural?...

The article is pretty sketchy on details, but it certainly appears to imply that someone fudged the prior art proof.
