DirecTV helps TiVo... but not TiVo users. While CNET reports that TiVo's partnership with DirecTV has driven subs up to the 1 million mark, my poor DirecTiVo satellite/DVR combo is orphaned sans the Home Media Option and any of the cool new software features (e.g. folders)--and, indeed, any software updates to speak of--appearing on the standalone Tivo boxes. The Web-based recording and ability to stream audio from my MP3 store to my hifi via TiVo were the very reasons I upgraded to a Series 2 TiVo. Sure is nice to see TiVo doing so well though; mind you, I do mean that--this particular beef is with DirecTV.

Earlier this month, I wrote about how it's become popular to use eBay as not just a buying and selling platform, but also as a PR platform for such things as selling towns - because you're almost guaranteed to get press coverage for selling something weird. Of course, it looks like there might also be a downside. Last year, a town in California received a ton of press for being put up on eBay, after conventional attempts to sell it had failed. That press coverage helped push up interest in the town until someone "won" the town with a bid of $1.8 million. Of course, as we pointed out at the time, with many such high profile auctions, the top bid is likely to be bogus. A few months after the original auction, it was reported that the sale still hadn't been finalized. Now, exactly a year after the original eBay auction happened, the folks who "own" the town are admitting that the buyer disappeared and never sent a check. Even worse, the sellers then went down the list of everyone else who bid on the town and failed to find a single legitimate buyer. Thus, the town is back up for sale - but not on eBay and at half the price of what they "sold" it for last year.

Following up on yesterday's post about NBC's apparent attempts to b0rk potential TiVoers of the Friends finale, BoingBoing reader Douglas Clark says,
I am a loyal Tivo user and Tivo did send out a message alert to users about the Friends episode. It was more along the lines of "if you manually extend the time of a recording, you may miss the beginning of the friends final episode." I find that Tivo is pretty good about catching unusual start times and other wonky tricks the networks play. The previous comment about HUT and ratings was right on the money...

Tech maven Meg Hourihan adds, "Even weirder is that I got a message on my Tivo warning me that the finale of Friends would have abnormal times. The message warned that if I wasn't just using the automatic "start on time" and "end on time" settings (i.e. I manually set the start time as 8 PM) that I might miss some. What makes things weirder and worse is that Tivo still didn't record the whole show! I made sure my settings were what the message instructed, and happened to watch the show live. Tivo kicked in to record at 8:59 PM (which is what it listed the start time as) but stopped at 9:59! According to the time on my digital cable box, the program didn't end until 10:03 PM. So if I hadn't watched it live, I would have missed the last four minutes. Seems like a major screw-up on Tivo's part, especially after sending out that message!"

Back in 2002 there was a tremendous amount of hype when Bridgeville, the small (mostly deserted) California town was put up for sale on eBay. It eventually sold in an auction for $1.8 million - and got a tremendous amount of press attention. The only problem: the $1.8 million bid was a hoax. A whole year went by and the owners of the "town" sheepishly admitted that the buyer (and his money) never showed up. Now, however, the town has been sold again - but not on eBay, and back down at its original asking price of $700,000. Even with the failure of the actual sale to go through, though, people still remember that you can "sell a town on eBay," contributing to the use of eBay as a PR platform beyond just its ability to match buyers and sellers.

Reuters is running a story about Intel that is chocked full of goo info, including information that their 'Manitoba' mobile chipset has finally found a customer in mmO2 Pic (the Manitoba came out two years ago, to little fanfare, let alone actual adoption by phone manufacturers). But the big news is that Intel will be working with Tivo to provide Tivo-to-Go functionality in future laptop chipsets, like their popular Centrino.

What that is, though, is unclear. Is it just a branding initiative? Tivo-to-Go already works on laptops (that's half the point), so will it be some sort of native support that makes it easier to move the Tivo content around? We don't know—the article is very vague—but at least Tivo is getting some name dropping love from a mega-vendor (considering it was unlikely they were going to get much help from Microsoft, considering they sell a competing product to Windows XP Media Center). In one of the uglier "intellectual property" abuses, DirecTV has been suing people for possession of tools it claims can be used to get TV shows without paying for them. The Electronic Frontier Foundation and Stanford Law School's Center for Internet and Society have challenged the satellite TV company on this conduct, and on Monday DirecTV agreed to modify its approach, according to this press release, which says in part:

The company will no longer pursue people solely for purchasing smart card readers, writers, general-purpose programmers, and general-purpose emulators. It will maintain this policy into the forseeable future and file lawsuits only against people it suspects of actually pirating its satellite signal. DirecTV will, however, continue to investigate purchasers of devices that are often primarily designed for satellite signal interception, nicknamed “bootloaders” and “unloopers.”

DirecTV also agreed to change its pre-lawsuit demand letters to explain in detail how innocent recipients can get DirecTV to drop their cases. The company also promised that it will investigate every substantive claim of innocence it receives. If purchasers provide sufficient evidence demonstrating that they did not use their devices for signal theft, DirecTV will dismiss their cases. EFF and CIS will monitor reports of this process to confirm that innocent device purchasers are having their cases dismissed.

Perhaps DirecTV saw some writing on the wall. On Tuesday, a federal appeals court has ruled that the company can't sue solely because someone possesses such equipment.
These are the kinds of stories that make me sometimes wish I lived in America. Good job EFF and Stanford Law School.

As DirecTV continues their campaign to threate n anyone who bought a smart card reader, even if they did so for completely legitimate reasons, it looks like some more evidence is coming out against them. A former employee working in their anti-piracy division is now suing the company suggesting they forced him to do illegal and unethical things in forcing innocent people to pay up. He says he felt like "a bag man for the mob" and talks about how the anti-piracy operation "was an elaborate extortion racket," that rewarded employees based on how much settlement revenue they brought in. He points out that this encouraged them to work as hard as possible to make everyone pay up, whether or not they had done anything illegal.
