The World Wide Web Consortium has taken up Microsoft's cause in a patent infringement lawsuit by urging the U.S. Patent and Trademark Office to invalidate the related patent "in order to prevent substantial economic and technical damage to the operation of (the) World Wide Web."

The latest in the Eolas patent saga is that someone at the Patent Office has finally agreed to review the patent based on stacks and stacks of prior art that people have been finding. Amazingly, the Patent Office appears to have responded quickly (though, they don't say how long it will take for a new decision on the patent) to the requests for a re-examination of the patent. There's a quote from the USPTO's deputy commissioner for patent examination policy saying that this was an "extraordinary situation" which necessitated the quick response. The problem with this statement is that it's not an extraordinary situation. In fact, it's an increasingly common situation, where silly patents are getting the stamp of approval every day - and then used to hold other companies up for extortion, rather than for encouraging innovation.

On Wednesday, Eolas scored another win in the ongoing Web-browser patent-infringement case between itself and Microsoft. A federal judge denied Microsoft's request to hold off on a decision on its appeal until the U.S. Patent Office reexamines the plug-in patent in question.

The patent office finally got one right (though, it took quite a while). Despite tons of prior art, and a patent that was far from "non-obvious", Eolas convinced a judge to award them over half a billion dollars from Microsoft for using embedded applications within IE. Microsoft started talking about changing the browser in a way that would have broken many web sites. After quite a bit of outcry from many different places, the patent office finally agreed to review the patent, and on second thought, are now rejecting the Eolas patent. Did it really need to take this much time, this many lawyers and this much outcry just to get a single bad patent reviewed and rejected? Isn't it about time we fixed the patent system?
