Due to certain confidential information obtained from Microsoft Corp. in the pretrial discovery process that Oracle Corp. is expected to raise at the trial concerning the U.S. Justice Department’s lawsuit to block Oracle’s takeover of PeopleSoft Inc., Microsoft will, in this instance, depart from its longstanding policy of not commenting on discussions related to potential mergers and acquisitions.

Microsoft today received a Recommendation from the Japanese Fair Trade Commission (JFTC) finding that a single provision in Microsoft’s agreements with computer manufacturers, the non-assertion of patents -- or NAP - provision, is inconsistent with Japanese law. News.com has a fantastic "offshoring roundtable" (mislabeled as an "outsourcing" roundtable) where they have a number of industry folks talk about issues concerning offshoring. Most of the pieces are fairly balanced (and you can tell the various biases) - and the whole thing stays away from the typical useless rhetoric concerning offshoring. The final piece, by Bruce Mehlman of the Computer Systems Policy Project may be the best, where he explains that those who are 100% pro-offshoring aren't using their hearts, while those who are 100% against offshoring aren't using their heads. He also comes up with a balanced approach to dealing with the downsides of offshoring, while still embracing the opportunity it represents. He points to the importance of opening up more markets, improving retraining and "lifelong learning environments," promoting innovation and improving our education.
