06/04/2004 11:25 PMThere's a great old Bloom County strip where the the lawyer character,
Steve Dallas, gets beaten up by Sean Penn for trying to snap a
paparazzi style photo of a drunk Penn. The strip focuses on Steve
Dallas trying to figure out "who to sue?" He goes through a variety
of options and explains why they're no good ("never sue poor people")
and finally decides that the
obvious choice is to sue Nikon,
the camera maker, for not putting a warning label on their cameras
that photographing drunken celebrities may lead to harm. This story
comes to mind following the news that a woman has
sued
Cingular, the mobile phone company, after a driver hit her car while
talking on his mobile phone. She also sued the driver of the car,
but hoped to get the big money from the wireless carrier. Even more
amazing is that after losing in a lower court,
she appealed
thinking that higher level judges would somehow accept her reasoning.
Thankfully, they didn't. The Court of Appeals has tossed out the case
as well: "A cellular phone does not cause a driver to wreck a car.
Rather, it is the driver's inattention while using the phone that may
cause an accident."

for all the hype around the idea that "driving while yakking" on a
mobile phone needs to be stopped, more people
eat while
driving - even though most consider it to be more dangerous. What
this comes down to is that there are many different types of driver
distractions. Simply picking one to pull out and ban raises questions
about how come other activities aren't banned. The focus should be on
educating people on the dangers of distracted driving - rather than
having everyone focus in on a narrow problem that doesn't address the
larger issue.

anti-spam companies
will bring in noticeably more revenue than the spammers
themselves. Of course, creating anti-spam products actually takes
some work, whereas spam is the job of lazy people who have no longterm
vision, but just want money as quickly and as easily as possible.
Still, when you look at the amount of money spent on both sides, it's
fairly stunning just how much money moves due to spam.

because Network Associates/McAfee has now been awarded a patent for an
idea that (sarcasm alert) no one could have possibly come up with
prior to December 2002 when they applied for it:

that there are now going to be anti-spam patent battles which will
slow down the process of stopping spam, and do no one any good,

point, AT&T finally made it clear

Headline News about maglev trains and it got the geek in me all
excited. They mentioned this one.
The experimental three-car maglev was carrying passengers
when it set the world's top speed for a train, clocking at 581 kph
(361 mph)...
Now, here's the deal: 600 m.p.h. in a plane is not really a
problem, because there's nothing to run into in the air (I know, I
know — other planes, buildings, the ground...don't get smart).
But 361 m.p.h. on train tracks? On the ground? Where there are
things like cars, and cows, and school buses full of little children
that could end up on the tracks? That 361 m.p.h. would seem so much
faster if you ran into something.
It happened in 1998 in Germany. One hundred twenty people died when abullet
train derailed and hit an overpass. And it was only travelling at 175
mp.h.
I don't want to be alarmist or anything, but that kind of speed,
that close to stuff that's as unforgiving as an overpass just makes me
a little nervous. And it's only a matter of time before Jon Voight
and Tom Cruise get into
a fight on top of one of them, and then what happens?

to move onto plan B. I've been asking since the CAN SPAM bill was
passed, how is the government planning to measure how successful (or
not) it's been - and what's plan B? Now that it's becoming
increasingly clear that

SPAM hasn't been even remotely successful - and has basically done
nothing to slow down the rise of spam, I want to know again, what is
the government's plan B? They were so proud of themselves for passing
CAN SPAM, yet they included no money for enforcement, no way to
measure how successful it was, and no plan B. In other words, yet
another law that makes for a good press release, and a good sound bite
at election time, but does nothing to solve a problem.

sandwich of the year: the Fat Darrell (invented by Darrell Butler
during his sophomore year at Rutgers University) contains chicken
fingers, mozzarella sticks and french fries. Maxim lauds it for its
"drunken ingenuity."
"So, I'm standing there eating it, and all of a sudden the guy
standing behind me says, 'That thing that guy's eating looks pretty
good, can you make me one of those?' And, it was like a movie scene,
the next 10 people order the same thing. So, I'm like, 'Whoa!' like I
think I might be onto something. And the guy is like, 'Hey, man, this
is cool.'"
That guy who assembled the sandwich was Abdul Eid, working in an R.U.
Hungry food truck, parked in a campus lot in New Brunswick, catering
to beer-soaked undergraduates with the late-night munchies.
Eid now runs R.U. Hungry Grill & Pizza, a store he was able to
open in part due to the success of the $4.75 Fat Darrell, the flagship
of R.U.'s "Fat" line.

confused as to what the big deal is about this. It's basically doing
two things: put antivirus protection at the network level instead of
the end client, which isn't a new idea at all and using an FPGA
hardware solution instead of software (which they seem to be saying is
faster). Am I missing something, or is this not that big of a deal?
