Web-hosting operation has ended, with one becoming a partner to the
other in the process.
Dallas-Fort Worth-based C I Host announced on Monday that a federal
judge dismissed a long-running suit filed against it by Microsoft.
C I Host is a global Web host and data center operator, serving
215,000 individual consumers and businesses in 190 countries.
The dispute goes back to September 2001, when Microsoft said it first
notified the hosting company of its concerns that it might not have
taken a service provider license agreement for Windows server
products. According to the complaint, C I Host responded in December
2001 by denying wrongdoing and threatening to sue Microsoft for
defamation if it went public with the charges.

should be defined isn't exactly new. However, Mark Rasch's latest
column at SecurityFocus picks apart common spyware definitions to
make you wonder if
it's useful at all to define what spyware is. Instead, he
suggests (as have others
before<
/a>) that the real issue isn't in defining and outlawing spyware, but
simply enforcing existing laws that already make most of the worst
offenders illegal by way of laws against fraud. Of course, that won't
happen, because politicians want to make sure they're seen as doing
something to make their constituents' lives better -- and a law
against spyware (just like the mostly useless law against spam before
it) is good for publicity, even if it does little to solve any real
problems.

strictly enforce the copyright. Wendy Seltzer points out what this

be certain to see the 19 footnotes in this relatively brief opinion,
or the 28 separate quotes the opinion includes from other peoples
work. I assume the court got a license for those.
Now that's not quite fair. The court's decision turns upon its
"literal" reading of the sound recording statute. The sound recording
statute has no de minimus exceptions, the court held. So while you are
free to copy three notes from a musical composition, you can't copy
the same three notes from a recording. So copying (so long as de
minimus) is fine; cut & paste is not. It is a "bright-line" rule the
Court has crafted: Ask permission first. (And don't worry, they might
have added.
It's
simple.)
So once again: life in the analog world is freer than life in the
digital world. You can do it, just don't use technology to do it --
unless, of course, your lawyer has spoken to their lawyer.
