My cow-orker Ren Bucholz has done a magnificent and pithy analysis of the parallels between the 1983 Supreme Court arguments in Betamax, in which the studios argued that the VCR should be criminalized, and last week's arguments in the 9th Circuit Appeals Court in Grokster, in which the recording industry argued the same thing about P2P file-sharing networks:
Later in last week's argument, Judge Thomas took Frackman's argument (knowledge - ability = contributory infringement) to its logical conclusion by asking whether he thought Xerox should be held liable when a UCLA student uses a photocopier to make infringing copies. Here's what happened to Kroft in '83:
Justice Stevens: Under your test, supposing somebody tells the Xerox people that there are people making illegal copies with their machine, and they know it. What are they supposed to do? ... Your view of the law is that as long as Xerox knows that there is some illegal copying going on, Xerox is a contributory infringer?

Kroft: To be consistent, your honor, I'd have to say yes.

By now, most people are quite familiar with the old Supreme Court "Betamax" ruling that said that a technology was legal as long as it had "substantial non-infringing uses." That's the standard under which many technologies we use today have been developed - and now it's under attack by the entertainment industry. Lawyers for the entertainment industry insist they're not trying to reverse the Betamax precedent, but to just set some limits on it. Supporters of the original decision say the entertainment industry still has always been looking for ways to get around the Betamax decision (and did so partially via the DMCA). What the article forgets to point out however, is the biggest joke in all of this: the entertainment industry that battled so hard against the Betamax decision was, by far, the biggest beneficiary of that decision. The fact that they still won't admit they made a mistake twenty years ago, and that maybe, just maybe, opening up technologies leads to more opportunities to profit shows just how short sighted the industry is. They're trying to kill off a legal ruling that has helped them generate billions of dollars each year.

It's not surprising that the RIAA would come out in defense of the INDUCE Act from Senator Hatch. They practically wrote the bill themselves. They had hoped to sneak it through without any debate, but a bunch of tech companies have stood up and pointed out how ridiculous this is. Meanwhile, plenty of others are showing what kinds of technology would be banned by the law. Realizing this might not sail through Congress as smoothly as they had hoped, the RIAA has now gone on the offensive. RIAA head Mitch Bainwol has sent a letter to all 100 Senators defending the bill, and saying that, contrary to the claims of others, it wouldn't overturn the famous Betamax decision (which allowed technologies that could be used for infringement, if they had substantial non-infringing purposes as well). Bainwol claims that "intentional inducement" is a much higher standard than was used in the Betamax ruling. However, as Ernest Miller points out in his INDUCE Act rebuttal, the only reason that's a higher standard is because there was no law against "inducing infringement" when the Betamax decision went to court.

According to Copyfight: En route to the Supreme Court Grokster hearing, former MPAA chief Jack Valenti -- who famously predicted in 1982 that the VCR would choke the life out of the movie biz -- stops to sign a VHS tape for EFFer Annalee Newitz.

Last week we noted a new study saying that people get annoyed with others talking on mobile phones because they only hear one half of the conversation. At the time, I wrote that this made sense as periods of silence followed by talking are a lot more jarring to the passive listener. However, this BBC report claims that the reason for the annoyance is that it shows that we're more curious about what the other party is saying. I'm not sure I buy that. It seems much more likely that it's the variability in noise, from silent to noisy rather than any form of curiosity. When the conversation is at a constant hum (even when loud), it's much easier to tune it out. Still, the findings do go against the opinion many people have expressed that things like "push-to-talk" where the phone usually acts as a speaker phone would be more annoying since we get to hear both sides of the conversation. In fact, the researchers behind the study are even suggesting that mobile phone makers may want to explore adding speaker phones to more phones to make them less annoying. Of course, the study only set up two conditions: a conversation on a mobile phone and a face-to-face conversation. They didn't test the speaker phone situation to see how annoying that was. It's possible that the annoyance factor comes from the inability to make use of body language to express concepts as well, leading to a different tone of voice.

Diane Stuemer , an Ottawa area entrepreneur, and her husband reevaluated their priorities in the early 90's after Diane was diagnosed with malignant melanoma and her husband had a work related accident. After her cancer went into remission, and fearful that her 3 children would grow up without remembering her, the family took the bold decision to pack up everything and circumnavigate the world. Despite having less than 4 days of sailing experience, the family took to the seas with great enthusiasm.

The Northern Magic became the Steumer's home for 4 years as they travelled around the world. During that time Diane wrote a series of weekly dispatches to the readers of her hometown's newspaper. It became a tradition in many Ottawa households to read Diane's column in the saturday paper while dreaming of the exotic locals she was writing about (a sharp contrast from Ottawa's winters).

In those 4 years, readers got to experience Herbert (the husband) become a master mechanic, Diane adapt to life afloat, and the 3 sons grow up. When the Stuemers finally arrived home in Ottawa in August of 2001 they where greeted by thousands of well-wishers.

Sadly, Ottawa residents learned early in February that Diane had been readmitted to hospital where she was fighting a very aggressive melanoma battle. Today, Diane succumbed to her illness and passed away.

During their voyage, the entire family took on several projects in the countries they visited which are still active today. What amazes me about Diane is the experiences she lived through with her children, the memories they will cherish and the lasting effect their travels will have on the people they met.

I'm seeing a certain bias towards the northern hemisphere of our globe. And still so many wonderful places to see! The thought is at the same time a bit depressing, yet joyful. I always hate the preparations before travel: packing, ticket hassles, looking for the passport... But once I'm actually in the plane, squashed in a space smaller than a phone booth, squeezed between an 8-year old hyperactive girl and a 200 kg fat man, eating a meal which tastes slightly better than the cardboard box it comes in, all of it becomes worth the while: Because I love traveling, seeing new places, hearing new voices, being dizzy with jet lag, fighting about living space with cockroaches and spiders, tasting local soft drinks and beers, smelling the polluted air in the cities or the clean air in the countryside, squatting in the middle of a herd of kangaroos, sweating like a pig, freezing like a penguin, ... Yah! Life!

Up here in Canada, American politics are a spectator sport; never as good as a really great World Series but better than most Super Bowls. This time around the Democratic race has outstanding entertainment value; we don’t know yet about the November event, but sometimes the divisional playoffs are more fun than the final anyhow...
