Reuters - American Jose Padilla proposed detonating an improvised nuclear bomb in the United States, but al Qaeda's leaders were skeptical he could do it and sent him on a mission to blow up apartment buildings instead, the U.S. Justice Department said on Tuesday.

US District Judge Michael B. Mukasey, in a funny 37 page decision devoted mainly to rebuking the government lawyers for their tendentiousness, delaying tactics, and "arguments permeated with the pinched legalism one usually encounters with non-lawyers," concludes by saying in effect, "I said you have to let Jose Padilla see his attorney, now let him see his attorney." I'm sure the government will appeal, and American citizen (and suspected terrorist) Jose Padilla will spend more time in jail without access to an attorney. He has spent 340 days there so far. The U.S. Second Circuit Court of Appeals has ruled that the President cannot legally order the continuing detainment of U.S. Citizen Jose Padilla, who was taken into custody O'Hare airport 18 months ago on suspicion of plotting to detonate a "dirty bomb". The court has ruled  that the military cannot hold Padilla, although the court notes that he can be turned over to a civil authority to face charges. The court noted, "[...] we find that the President lacks inherent constitutional authority as Commander-in-Chief to detain American citizens on American soil outside a zone of combat."
