NEC-Business Network Solutions Inc. (NEC/BNS) has pleaded guilty to defrauding a U.S. government program for school Internet connections, settling criminal and civil cases against the company through a US$20.6 million plea agreement. Judge Charles Breyer of the U.S. District Court for the Northern District of California approved the proposed plea agreement on Thursday with only minor changes in wording, according to an NEC/BNS spokesman who asked not to be named.

    People have been talking about the problems of zombie machines spewing spam for a while. One of the biggest issues is how to get the broadband providers to do something about it, and to help stop the flow of spam from the computers of users who have no idea they're sending out spam. One of the biggest targets in this discussion is Comcast - who, by their sheer size in the market, appears to have the most subscribers with compromised machines. In fact, last week, they admitted that they were, technically, "the biggest spammer on the internet." They say that Comcast users send out 800 million messages a day - and 700 million of them are spam from zombie machines. Many have complained that Comcast hasn't taken the situation seriously, but that seems to have changed lately. Over the last few months they've been a lot more proactive in letting subscribers know that their machines have been taken over - but it still takes a while, and end-users who end up getting cut off are often not savvy enough to understand what's happening or how to fix it. One potential solution is to block port 25 - something that many other ISPs do - but Comcast has rejected that plan, knowing that the complaint and support costs would be overwhelming. Instead, it sounds like they've come up with a fairly creative method of dealing with the problem. They're going to monitor overall usage, and if they become aware of a problem, they will remotely adjust only that user's modem to block port 25. While this may still cause an occasional headache for some users, the overall impact should be much lower, and the non-tech-savvy zombie-fied customer will have the problem they didn't know about solved without them knowing about it as well.

    Jani of Marginaali has received a response from the Finnish Deputy National Police Commissioner (i.e. the Chief of Police Force) via Enterblogi. The police admits that a single officer had no right to order a web page to be censored, even if a possible crime had occurred, and that "the law regarding the freedom of speech and mass media is not known well enough among the police."

    While it is worrying that the police do not seem to know the law, it's very positive that mistakes are acknowledged and hopefully learned from. A memo has been sent to the Oulu Provincial Police Command, and it's likely that the state provincial office will also need to address the issue due to an official complaint from Jani.

    This is not the first case, nor will it be the last. In fact, my guess is that we'll see at least another attack like this against online personal publishing. Granted, there are some blogs which probably deserve it, but as this is arguably a new domain of publishing, the legislation will have to be tested in the blogosphere as well. And as such, I welcome it, as it clears the rules and the playing field. I just hope nobody would need to suffer for it...

    Jani has been called in for questioning by the local police on the matter for next Friday. This will be interesting...
