Seth Finkelstein has made a startling discovery, backed with lots of evidence: when a spam result comes up in a search, Google not only blocks the spam, but every result after it. This means that for searches where spam results manage to rise to the top, very few -- sometimes zero -- results will be returned. Examples: motorcycle candle, keyboard bracelet. These are common words for which you'd expect to see results (in fact, the latter even says there are thousands of results) but the bug prevents them from being seen. Eliminating the spam pages (by blocking a word, antenna, that appears on them) allows full results to be displayed. It's pretty amazing that such a serious bug made it past Google's tests. It will be interesting to see how quickly it's fixed....

The FCC wants to stop spam from reaching your PDA and/or cell phone. It's a step in the right direction and much appreciated, but may not protect cell phones and PDAs from forwarded spam emails.

The Federal Communications Commission yesterday moved to prevent cell phones and personal digital assistants (PDAs) from becoming the next major frontier for e-mail spam.

The agency issued rules requiring marketers to have explicit permission from wireless-device users before they can be sent any commercial e-mail. And it urged the industry to develop technologies to prevent spam from overwhelming wireless devices the way it has swamped computer messaging.

"By prohibiting all commercial messages to wireless phones and PDAs absent affirmative consent from the consumer, Americans can now use their wireless devices freely, without being bothered by unwanted and annoying messages," FCC Chairman Michael K. Powell said in a prepared statement.

The rule covers a rapidly expanding array of Web-based e-mail services offered by wireless providers that enable customers to send and read messages via their phones or PDAs.

CMP Techweb.com's editor in chief, Fredric Paul, says the report I linked to yesterday is incorrect. He writes:

Anyway, we saw that you picked up the CyberJournalist piece on CMP blocking access to our stories from Google News. I don't know where that came from, but it is wrong. We do not and have never blocked access from Google or any other search engine. That's easily testable, try it yourself. We do, however, intercept links from certain competitors who reproduce significant portions of our stories on their own pages -- sometimes even stealing the first link-- before they finally post a link to our original material. In most cases, the intercept we put up allows the reader to then click to their intended destination. Other major technology publishers, including IDG, do similar things. We're not just old media, and we're not completely clueless.

A few months back, France fined Google for selling ads based on trademarked terms. I was surprised, because in my own experiments with Google ads, I've had a few ads that were rejected because they (according to Google) contained trademarked terms. Personally, I don't see how buying a keyword is, in any way, a violation of trademark. The point of a trademark is to protect the company from having someone else appear to be you. You can't sell Bob's Cola and put a Coca-Cola label on it. However, if someone is looking for Coca-Cola, there's nothing wrong with suggesting they might also want to look at Bob's Cola, as well. Anyway, now it looks like Google may get hit from the other side as well. They've been fined for selling ads based on trademarks, and now, apparently, they're going to ge t sued for blocking ads based on trademark complaints. The pending lawsuit apparently says that Google is banning ads on terms that aren't trademarked as soon as anyone complains. That is, Google doesn't check to see if there's an actual trademark - they just ban the ad as soon as there's a complaint. The group that's going to sue says they've brought together over 3,000 complaining advertisers who have had ads blocked. As mentioned, I've had my ads blocked too, but this seems like a ridiculous lawsuit. Where in the law does it say that Google has to sell you ads for whatever you want? They have the right to reject ads for whatever reason they want. It is their system, after all. If people believe they're blocking ads unfairly, then isn't that an opening for competitors to better serve advertisers by offering them something that Google doesn't?

Sometimes it's worth repeating the mantra that lawyers understand the law, and not business. Just because a lawyer tells your business it can do something, it doesn't necessarily make sense to actually do it. It makes absolutely no sense, for instance, that CMP has apparently decided to ban all incoming links from Google News, just because they excerpt a couple sentences (and maybe an image). They are actively turning away traffic, and this is a business that is based on advertising. Perhaps this is just a mistake, but if it's not, it's a stupid policy that is going to cost CMP plenty of visitors (read: ad revenue) because some lawyers made a bad decision. Do they really think this will somehow bring them more visitors who will go to their front page instead? It won't. It will bring them many fewer visitors, because they've just cut off their most directed channel of traffic.
