One of the reasons that the web caught on was that HTML was so easy that, with barely any training at all, anyone could create a website. Obviously, that has its downsides as well, as many websites are dreadfully designed. As accessibility issues become more important for websites, it has some wondering if web designers should be regulated, where official web designers would need specific certification, and couldn't use the title "Web Designer" without it. While the HTML purists might like such a thing, it seems like a fairly silly way of going around and improving HTML. A better case could be made for just showing people how bad design harms their business or visitors.

The Federal Election Commission started to extend campaign finance rules to the Internet. According to CNET News.com, the proposed changes would have made any website over 500 readers post government-mandated notices or risk violating campaign finance laws. The original reforms would have imposed Federal rules from decades ago on websites. But at the last minute, the proposals changed.

The explanation for the dramatic changes during the last two weeks, according to one FEC official familiar with the events, is the unusua l public outcry that followed a public alarm that Commissioner Bradley Smith sounded about a pending government crackdown on bloggers. After Smith's warning, an army of bloggers mobilized to oppose intrusive regulations and prominent members of Congress warned the commission not to be overly aggressive.

The regulatory approach was necessary because of "the increased use of the Internet by federal candidates, political committees, and others to communicate with the general public to influence federal elections," according to the March 10 draft.  "If the March 10 draft had gone into effect, it would have been bloggers with pitchforks and torches storming the Federal Election Commission at 999 E Street," said Mike Krempasky, a contributor to conservative Web site RedState.org and co-creator of an online petition on behalf of bloggers

Great news for VoIP companies! Internet Week is reporting that VoIP providers will be able to remain free from state regulation. The final decision was rendered in thanks by the U.S. Court of Appeals for the Eighth Circuit in St. Louis. It seems that their ability to escape the potential regulation comes from the simple fact that VoIP is not considered to be a true telephone service….

The latest Above the Crowd column from Bill Gurley takes a close look at a recent 9th Circuit Court of Appeals decision concerning whether or not cable broadband services should be regulated as a telecommunications service by the states. Gurley trashes the ruling (which decided they should be) saying that it goes against what the federal government has made clear as well as against what makes the most sense for the internet. Instead, the only group to benefit from this ruling are the state Public Utility Commissions. Everyone else will suffer. He admits that some say the regulation could increase competitiveness, but points out that DSL is already regulated this way and is losing out to unregulated cable offerings (which are even more expensive). He suggests that the market has already shown that they favor an unregulated solution. I agree with the general premise, but I'm not so sure that the current lead cable has is because their "winning" the competitive battle so much as they've more effectively leveraged their own monopoly. I use cable modem service at home because that was the only choice I had - and no one else has come along to offer a compelling alternative yet. However, because my service is a monopoly, it's treated as such: meaning the customer service is dreadful and the prices keep rising. So far, the DSL providers have had their own problems. The real issue is that neither side is doing much to make consumers happy.

In movies from not-too-many decades ago, we'd see a doctor walk into a hospital room and take a clipboard from the foot of the bed. He'd ask the patient a few questions, check some instrument readings then make some notes on the chart and re-hang the clipboard. After he leaves the room, a friend of the patient would look at the clipboard but be unable to read the doctor's handwriting. This scene could be played for either humor or bathos depending on the writer and director.
