Clear Channel Finds Another Way to Abuse Artists: Patents. The company recently bought a patent for recording a CD of a concert immediately after the show. A profitable, artist-empowering industry currently uses the technology, but Clear Channel plans to enforce its patents across and beyond its 130 U.S. venues. [EFF: Mini Links]

OK - so this is a clear opportunity for someone (EFF?) to bus these dam patents.

This one - claiming that you can't record a show and burn a CD - most probably has plenty of prior art/usage on it.  You telling me that NO ONE recorded a show and burned it - before this patent was applied for?

I bet not.

I bet there are folks back at the JVC labs in Kamakura who were recording shows and burning CDs as far back as 1984-5.  I was in an impromtu show at the JVC labs in 1987 that was then turned into a CD, and they told me they had been doing for a while.  When was this patent applied for?

Realizing that any real patent reform is going to take decades, and that everyone is suffering now from bogus patents, it appears that the EFF is setting up a project to try to proactivel y bust bogus patents. It's a great goal, but it remains to be seen how effective they are. Others have tried to do similar things (though, perhaps with different tactics) without much success so far.

Cory Doctorow: Richard Stallman, creator of the Free Software movement, has written a tremendous essay for the Guardian on the risks of software patents. Richard undertakes a gedankenexperiment about "literary patents" and the impact they would have had on Victor Hugo as he sat down to pen Les Miserables.
Now consider this hypothetical literary patent: Claim 1: a communication process that represents, in the mind of a reader, the concept of a character who has been in jail for a long time and subsequently changes his name...

These patents would all cover the story of one character in a novel. They overlap, but they do not precisely duplicate each other, so they could all be valid simultaneously - all the patent holders could have sued Victor Hugo. Any one of them could have prohibited publication of Les Misérables.

You might think these ideas are so simple that no patent office would have issued them. We programmers are often amazed by the simplicity of the ideas that real software patents cover - for instance, the European Patent Office has issued a patent on the progress bar, and one on accepting payment via credit cards. These would be laughable if they were not so dangerous.

David Pescovitz: Two couples in Nashville were busted this week for printing out their own UPC bar codes and slapping them on products in Wal-Mart and other stores to lower prices. Allegedly, they were part of a larger ring in 19 states that over the last decade would buy the, er, "discounted" items and later sell the goods or return them in exchange for gift cards that they'd also peddle. Authorities say that the scheme defrauded Wal-Mart alone of $1.5 million. Link

Usually when I go home to Boston to visit my family, I spring for the Acela train because you get guaranteed seating and it's fairly fast (~3.5 hours). But it's also very expensive, nearly $200 round-trip. So this past weekend I resorted to my old friend, the Peter Pan bus. And would you believe it, if you purchase your ticket online in advance (all you seem to need is one day before you depart), it's $30 round-trip. $30! Ok, they stick you with a $4 fee for "will call pick-up" but still, that's nearly six trips to Boston for the price of one train trip. And both ways, my journey was four hours exactly. Sure, it wasn't as pleasant as the train, and there's no plug for your laptop, and they showed the movie The Recruit both ways, but what do you expect for that price? I'm going to take the bus more often, I just can't resist a bargain!

MX Logic, a firm who has been tracking CAN-SPAM complience, says, "Get a good spam filter, because despite federal law, it's not going away anytime soon."

The numbers don't lie: CAN-SPAM is a bust. Compliance with CAN-SPAM has fallen to a new low, according to recent data collected by MX Logic.

In July, compliance fell for the first time under one percent to a measly 0.54 percent of all unsolicited commercial mail the company sampled during the month.

The Denver-based firm has been tracking compliance with CAN-SPAM since the federal law went on the books in January. Through April, MX Logic's numbers remained stable, with about three percent of spam messages complying with the law's requirements, which range from verifiable return addresses to measures consumers and businesses can use to opt out of mailing lists. In May and June, however, the number slipped to one percent.

"Now it's been halved," said Steve Ruskin, a senior analyst at MX Logic. "No one's really sure what's going on, but it's clear that CAN-SPAM isn't a threat to spammers. They're just ignoring it."

According to Gentle Giant Studios, this version was created by Dark Horse Comics for distribution through Borders Books. Along with Chewie, the exclusive set included a clear Yoda and a copy of Dark Horse's Clone Wars #1. Bust-Up fans will definitely want to check with their local Borders for availability.
