I found this link earlier in the week and have been playing around with it tonight. If you are looking fro new music that you can add to your collection there is a great deal of music out their that bands are very happy for you to download. Pulling that music can prove time consuming but using a old school program called wget you can click start go to bed and wake up in the morning with a 100 new songs to review. In the past year and a half, Techdirt has received five or six threats of legal action for things written on the site (one time we even received two completely separate legal threats on the same day -- which actually was quite confusing). None of these went very far, as a quick review of every situation showed they were baseless. In every case, the threats involved statements (usually in the comments) that someone didn't want to be out there, but which were clearly perfectly legal. What most of those doing the threatening failed to realize was that if legal action was taken, the first thing that would happen would be a public discussion of what was happening -- meaning a random comment from years ago on the site that no one looked at any more, would suddenly get a lot more attention (see: Streisa nd, Barbara). Anyway, it looks like more sites (especially in the blog realm) are learning not to freak out every time they get a cease & desist letter, but to push back, and even publicize the threats. At some point, lawyers will wise up and realize that baseless legal threats, with the hope that the legalese will scare a non-lawyer, have a very high likelihood of backfiring in a big way.

Whether they understand the economics of it or not, it appears that things are continuing to move forward pretty much as we expected in the music business. Companies are realizing that music is a promotional good, and not necessarily something that should be sold on its own. With that in mind, many big brand companies are looking to give away lots of legal free music in the coming year. Of course, the recording industry still hasn't figured this out completely, and will still stick to its guns and charge $0.67/track - which will be paid for by the big brands giving away the music. Sooner or later, though, pricing pressure should show up enough to force the industry to lower their own prices as well, no matter how much they complain.

For a totally arbitrary, but supposedly "symbolic" milestone, the global music industry is celebrating that there are now over 100 legal music services available. Don't ask what kind of sites make it to the list, that's not the important part. The important part is that now music lovers have more music formats to choose from than ever. Woo hoo! So instead of making it easier for people to download music in a simple, transferable format, we now have a bunch of different formats that we have to track down from over 100 sources. Sounds like progress to me.

People have pointed out in the past that one of the major limitations to online download music stores is the fact that certain popular artists have not allowed their music to be (legally) offered online yet. Exhibit number one is always the Beatles. Well, now it appears that the Beatles are finally warming up to the idea, but only if someone is willing to pay them lots and lots and lots of money for the right to set up an exclusive Beatles store. That's right, the music wouldn't be available in just any download store, but a Beatles-only music store that would be run by some other company. While the article mentions Apple iTunes as a possibility, this seems unlikely unless the Beatles and Apple patch up their legal problems first. Either way, this points out just how ridiculous all these different online stores are. Would the Beatles have ever become famous if you could only buy their music in exclusive Beatles-only record stores, which would then only play on special Beatles-only record players, that had all sorts of limitations on what you could do compared to other music you owned? The Beatles may have been great musicians, but they now appear to be greedy and shortsighted in their attempt to move into the online world.

On January 12, the University of Pennsylvania began providing its on campus student body free access to Napster 2.0's subscription music service through a campus-wide contract with Napster. The contract allows students to listen to streaming audio or "tethered downloads" for free. (Tethered downloads are downloaded music files that will only play as long as the user maintains a subscription to Napster, or in this case, as long as the student remains at Penn State.) Alternately, students can pay 99¢ a track to burn songs to disk or transfer them to a mp3 player.

According to the Chronicle of Higher Education (subscription required) other schools are watching the experiment closely to see if the availability of free legal music downloads will reduce illegal file sharing on campus. As part of the contract, Napster has provided local caching servers for about 90 percent of the most requested songs which is expected to improve performance and reduce network congestion. According to Penn State Live , almost 3000 students (of 17,000 eligible students) registered for the service on the first day, streaming or downloading about 100,000 songs. No network congestion was reported.

In my experience, most of the RIAA-hating nerds who swear they'll never to buy another album again continue to download copyrighted, RIAA-financed music from less-than-legal sources (and I've done it, too, so simmer down). What's crazy, though, is that if you really don't want to bend any laws, there is a wealth of free music online -- and The Red Ferret Journal just set up a Wiki (a user-edited web page) to make it even easier. There are hundreds of thousands of freely downloadable songs on the websites listed (some of them are even not techno) and thousands more non-RIAA-backed labels selling songs, too -- so if you really want to fill up that iPod without "stealing music," you do have an option to do so.

Mainly, though, I just wanted you to feel extra guilty when you download RIAA music anyway.
